HomeMy WebLinkAboutCouncil Minutes - 2002-06-10 S SPECIAL COUNCIL MINUTES JUNE 10,2002 CITY OF KITCHENER A special meeting of City Council was held at 1 :07 p.m. this date, Chaired by Mayor C. Zehr and with all members present except Councillor B. Vrbanovic. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Mayor C. Zehr advised of two additional in-camera items involving a personal matter and a matter subject to solicitor-client privilege. Moved by Councillor C. Weylie Seconded by Councillor J. Smola "That Council meet in-camera this date to consider two personal matters, a labour relations matter and six matters subject to solicitor-client privilege." Carried. The special Council meeting then recessed at 1 :08 p.m. and re-convened at 7:11 p.m. with all members present except Councillor G. Lorentz. It is noted for the record that pursuant to Section 25.8.9 of Chapter 25 (Council Procedure) of the Municipal Code, Councillor J. Smola disclosed a pecuniary interest relative to a matter subject to solicitor-client privilege at an in-camera meeting of City Council held this date. Council was in receipt of Corporate Services Department report CRPS-02-139 (G. Melanson), dated June 5, 2002, recommending that Council re-confirm its approval to expropriate lands required for the construction of the Doon Village Road Diversion. Moved by Councillor M. Galloway Seconded by Councillor B. Vrbanovic "That this Council did receive an application for approval to expropriate land, dated June 10, 2002, from Gary V. Melanson, Assistant City Solicitor, respecting the following lands west of Doon Village Road and described as Part of Lot 2, Biehn's Tract, designated as Part 4 on Plan 58R-13325, in the City of Kitchener, for the purpose of a new road." Carried. Council was in receipt of Corporate Services Department report CRPS-02-149 (J. Shivas), dated June 7, 2002, recommending extension of the City/Hallman Brierdale Limited agreement for the sale and purchase of the Kolb Drain lands. Moved by Councillor B. Galloway Seconded by Councillor C. Weylie "That the date for waiving conditions in the agreement dated July 4, 2001 to sell the City's Kolb Drain lands to Hallman-Brierdale Limited be extended for a further period of 120 days from June 10, 2002; and further, That the City consent to the submission of an application for approval of a draft Plan of Subdivision on the said lands." Carried. Council was in receipt this date of Development & Technical Services Department report KFD-02-140 (R. Browning), dated June 10, 2002, recommending the appointment of a Deputy Fire Chief. Moved by Councillor C. Weylie Seconded by Councillor M. Galloway "That Mr. Donald Trask be appointed as a Deputy Fire Chief effective Tuesday, June 11, 2002." Carried. SPECIAL COUNCIL MINUTES JUNE 10,2002 - 231 - CITY OF KITCHENER Council was in receipt of Community Services Department report CSD-02-126 (F. Pizzuto), dated June 6, 2002, recommending approval of the modifications to various agreements between the City of Kitchener and Barrel Works Inc. J. Shivas, City Solicitor, informed Council that the second clause of the recommendation should be amended to read reference the date of the contracts, June 7, 2002, not the report. Moved by Councillor C. Weylie Seconded by Councillor J. Ziegler "That the City of Kitchener ratify extension agreements six, seven and eight to extend the fulfillment or reviewing of conditions from May 1, 2002 to May 9, 2002, May 10, 2002 to May 31, 2002 and June 1, 2002 to June 14, 2002 respectively; and further, That the City approve the revised Construction Contract dated June 7, 2002." Carried. Moved by Councillor M. Galloway Seconded by Councillor C. Weylie "That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk. (a) Being a by-law to amend By-law 73-90 to provide for the Fire Chief and Deputy Fire Chief to retire at age 60. (By-law No. 2002-110) (b) Being a by-law to appoint a Deputy Fire Chief. (By-law No. 2002-111) (c) To confirm all actions and proceedings of the Council. (By-law No. 2002-112)." Carried. On motion, the meeting adjourned at 7:15 p.m. MAYOR CLERK
