Heritage Kitchener met this date, commencing at 4:05 p.m., chaired by Councillor M. Galloway, with the
following members present: Ms. P. Wagner, Ms. G. Engel and Messrs. J. Clinckett, Z. Janecki, B.
Krafchek, B. Nixon and B. Scott. Mr. E. Lucy was in attendance for part of the meeting.

HERITAGE PERMIT APPLICATION 2002-V-18
16 SENECA DRIVE - CONSTRUCTION OF NEW GARAGE
ST MARY'S HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application # 2002-V-18, dated 02-05-28, for
the property municipally known as 16 Seneca Drive, located in the St Mary's Heritage
Conservation District. In the application permission is being sought to construct a detached
garage in the rear yard. Drawings of the proposed garage and the sketch of the property
showing the proposed location of the garage were attached to the application.
Mr. Alec Brown, applicant, was in attendance in support of the application.
Mr. L. Bensason explained the request and showed images of the subject property.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owner
(HPA # 2002-V-18) to alter the designated property municipally known as 16 Seneca
Drive, located in the St. Mary's Heritage Conservation District, by constructing a detached
garage in the rear yard, as shown on the drawings submitted with the application, be
approved."
HERITAGE PERMIT APPLICATION 2002-V-17
15 RICHMOND AVENUE - DEMOLITION OF REAR SHED & CONSTRUCTION OF
REAR DECK
VICTORIA PARK AREA HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application # 2002-V-17, dated May 26, 2002,
seeking permission to demolish the rear shed and construct a rear deck on the property
municipally known as 15 Richmond Avenue, located in the Victoria Park Area Heritage
Conservation District. A property location plan, site plan and construction details for the
proposed deck were attached to the application.
Mr. D. Fletcher, applicant, was in attendance in support of the application.
Mr. L. Bensason displayed images of the subject property and explained the application.
On motion by Mr. B. Scott -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owners
(HPA # 2002-V- 17) to alter the designated property municipally known as 15 Richmond
Avenue, located in the Victoria Park Area Heritage Conservation District, by demolishing
the rear shed and constructing a rear deck, as shown on the drawings submitted with the
application, be approved."
Mr. E. Lucy entered the meeting at this time.

HERITAGE PERMIT APPLICATION 2002-V-16
41 MICHAEL STREET - CONSTRUCTION OF NEW FRONT PORCH
VICTORIA PARK AREA HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application #2002-V-16, dated May 30, 2002,
requesting permission to construct a new front porch on the property municipally known as 41
Michael Street, located in the Victoria Park Area Conservation District. Attached to the
application is a property location plan, sketch of the property showing the location of the new
front porch, and drawings giving details of the design and construction of the porch.
Mr. and Mrs. Valin, applicants, were in attendance in support of the application.
Mr. Bensason showed images of the subject property and of another home in the Heritage
Conservation District of a similar design with a front porch.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owners
(HPA # 2002-V-16) to alter the designated property municipally known as 41 Michael
Street, located in the Victoria Park Area Heritage Conservation District, by constructing a
new front porch as shown on the drawings submitted with the application, be approved."
HERITAGE PERMIT APPLICATION 2002-V-19
379 QUEEN STREET SOUTH - CONSTRUCTION OF ADDITION CONNECTING MAIN
RESIDENCE TO COACH HOUSE
VICTORIA PARK AREA HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application # 2002-V-19, dated May 30, 2002,
seeking permission to construct an addition which will attach the main building on the property to
the coach house at the rear. Attached to the application were drawings showing east and west
elevations of the proposed addition, as well as a floor plan and a property location plan.
Mr. Z. Janecki declared a pecuniary interest in this matter as he is employed by the applicant,
and did not participate in any discussion or voting with respect to this application.
Mr. R. Dyck, Architect/Engineer, was in attendance to present the application, and displayed
revised drawings of the proposed addition. He showed samples of building fabric for the
proposed addition, noting that the final decision on the type and colour of brick has not been
chosen.
On motion by Mr. B. Scott -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owner
(HPA # 2002-V-19) to alter the designated property municipally known as 379 Queen
Street South, located in the Victoria Park Area Heritage Conservation District, by
constructing an addition which will join the main building to the coach house at the rear of
the property, as shown on revised drawings A2.1 and A3.1 prepared by Robert J. Dyck,
Architect & Engineer, be approved subject to the following condition:
That the owner shall obtain the approval of a sub-committee consisting of the City's
Heritage Planner and Mr. B. Scott for the colour of brick to be used in the addition."

6 BUERKLE - CONSTRUCTION OF NEW FAMILY DWELLING
UPPER DOON HERITAGE CONSERVATION DISTRICT
The Committee was in receipt of Heritage Permit Application # 2002-V-20, dated June 3, 2002,
seeking permission to construct a new, two storey single family dwelling with an attached three
car garage on the property municipally known 6 Buerkle Court. Attached to the application is a
property location plan, site plan and drawings of the proposed building.
Mr. G. Scheels, Green Scheels Pigeon, was in attendance in support of the application. He
displayed samples of the brick and siding proposed for the building.
The Committee was also provided with copies of a written submission from Mr. R. Haalboom to
Ms. Dianne Gilchrist, Heritage Kitchener Committee Administrator, dated June 11, 2002,
attached to which is a letter from Mr. Haalboom to the Chair and members of Heritage Kitchener,
dated June 10, 2002, providing Heritage Kitchener with his opinion as to the applicability of
various laws and planning documents to this application.
Several Committee members voiced their concerns in dealing with this application in light of Mr.
Haalboom's written submission.
On motion by Mr. B. Scott -
it was resolved:
"That an in-camera meeting of Heritage Kitchener take place immediately to obtain a legal
opinion concerning the law suit filed by Mr. R. Haalboom against the City of Kitchener,
with respect to the portion of the Monarch subdivision located in the Upper Doon Heritage
Conservation District."
The meeting recessed at 4:55 p.m. and reconvened at 5:40 p.m. with the following members
present: Councillor M. Galloway, Ms. P. Wagner, Ms. G. Engel and Messrs. J. Clinckett, Z.
Janecki, B. Krafchek, E. Lucy, B. Nixon and B. Scott.
The Committee then considered Heritage Permit Application #2002-V-20, for the construction of
a new single family dwelling and garage at 6 Buerkle Court.
On motion by Mr. Z. Janecki -
it was resolved:
"That pursuant to Section 43 of the Ontario Heritage Act, the application of the owner
(HPA # 2002-V-20) to alter the designated property municipally known as 6 Buerkle
Court, located in the Upper Doon Heritage Conservation District, by constructing a new
single family dwelling and garage as shown on the plans submitted with the application,
be approved."
The following members are recorded as abstaining from the vote in this application: Ms. P.
Wagner, Ms. G. Engel, Mr. J. Clinckett and Mr. B. Krafchek.
Note:
Subsequent to the meeting it was determined that under Council's Procedural By-law an
abstention is considered a vote in the negative. This was not understood by the
Committee members at the time the vote was taken. This information has been given to
Heritage Kitchener members and City Council.

NETWORK FIBRE CONNECTION FOR VICTORIA SCHOOL COMMUNITY CENTRE
The Committee members were provided with copies of Heritage Permit Application 2002-1V-21,
dated June 6, 2002, seeking permission to install a network fibre connection for the Victoria
School Community Centre.

Mr. L. Bensason displayed images of the building showing the area where the network fibre
connection intended to be installed.
On motion by Mr. J. Clinckett -
it was resolved:
"That pursuant to Section 33 of the Ontario Heritage Act, the application of the owner
(HPA # 2002-1V-21) to alter the designated property municipally known as 25 Joseph
Street (former Victoria Public School) by installing a network fibre connection into the
Victoria School Community Centre, as shown on the drawings submitted with the
application, be approved."

530-540 QUEEN STREET SOUTH - NEW DEVELOPMENT (DREWLO HOLDINGS)

The Committee was in receipt of following documentation:
a)
Heritage Impact Assessment for 530 & 540-560 Queen Street South, prepared by Mayer
Heritage Consultants Inc;
b)
Illustrations of the Queen Street and North elevations of the revised proposed
development at 560 Queen Street South;
c)
Peer Review - Heritage Impact Assessment - 530, 540-560 Queen Street South, City of
Kitchener, prepared by Unterman McPhail Associates, dated May 29 ,2002, attached to
which is a covering letter form Mr. J. Willmer, Director of Planning, dated May 31,2002;
d)
Addendum report to the Heritage Impact Assessment - 530, 540-560 Queen Street
South, City of Kitchener, prepared by Mayer Heritage Consultants Inc., dated June 6,
2002; and,
e)
Heritage Permit Application 2002-V-03, dated 2002-01-09 for 530-540 Queen Street
South.
Mr. Z. Janecki declared a pecuniary interest in this matter as he is employed by a company that
has an interest in the application, and did not participate in any discussion or voting with respect
to this matter.
Mr. L. Bensason declared a conflict of interest in this matter and abstained from providing any
advice to the Committee in this regard.
Mr. J. Willmer provided a brief overview of the process to date with respect to the Heritage
Permit Application and the Heritage Impact Assessment process. With respect to the Heritage
Impact Assessment and Addendum before the Committee this date, he requested the
Committee's comments on Parts 1-4 & 7 of the Assessment.
Mr. B. Hermsen, MacNaughton, Hermsen, Britton, Clarkson Planning Limited, was in
attendance. He advised the Committee the Heritage Impact Assessment speaks to a specific
building plan. He noted that subsequent to the preparation of the Heritage Impact Assessment
an open house was held and comments received from neighbouring residents. Mr. Hermsen
then displayed a revised building design and siting, with a greater portion of the building mass on
the Queen Street frontage, and the building being located further from Schneider Avenue.
Mr. Hermsen advised that another meeting had been held with neighbourhood residents on

Monday June 10, 2002, at which further neighbourhood comments had been presented. These
additional comments have yet to be fully considered in terms of building design. He advised that
the design of the front fence is also being reconsidered.
Mr. Hermsen then requested that Heritage Kitchener defer consideration of the Heritage Impact
Assessment and Heritage Permit Application, and hold a special meeting on or about June 26th
to consider these matters. He also asked the Committee to recommend to Council that they
defer consideration of these matters to their meeting scheduled July 2, 2002.
He then advised that consideration of the residents comments and concerns, including the
written submission from "KNAD - Kitchener Neighbours for Appropriate Development", dated
June 7, 2002, will take place over the next week, and a revised building design will be presented
to the residents later next week.
Three delegations: Ms. J. Armstrong, Ms. D. Westman and Ms. M. Cadotte, addressed the
Committee, presenting their concerns/comments, as outlined in their written submission "KNAD
- Kitchener Neighbours for Appropriate Development - Response to Heritage Impact
Assessment - 530-560 Queen Street South", dated June 7, 2002. This written submission had
been distributed to members of Heritage Kitchener by KNAD prior to this meeting.
In addition to outlining their concerns to the Heritage Impact Assessment, Ms. D. Westman
presented three potential building layouts which they consider to be compatible with the
neighbourhood, which would only slightly reduce the floor space ratio permitted in the zoning by-
law.
The delegations advised they are in support of the deferral requested by Mr. Hermsen. In
addition, they asked that a further public meeting be required at which a final building design
would be presented to the residents, prior to being considered by Heritage Kitchener. In this
regard a written submission was presented to the Committee by the delegations outlining the
steps they request be taken for the proposed public meeting.
Councillor M. Galloway clarified the three matters Heritage Kitchener must address at this
meeting:
a)
the request to defer consideration of the Heritage Permit Application to a special meeting
of Heritage Kitchener on June 26, 2002;
b)
a request to Council to defer consideration of the Heritage Permit Applicaiton to its
meeting scheduled for July 2, 2002; and,
c)
the request of KNAD for a further public meeting to allow an opportunity for area residents
to comments on a new building design; along with guidelines from KNAD for notice of the
public meeting and availability of any report from the developer's consultants.
Ms. P. Wagner questioned what will happen with the Heritage Impact Assessment as it currently
exists. She offered support for the comments contained in the KNAD submission and
questioned whether the Heritage Impact Assessment will be changed accordingly.
Mr. Willmer advised the owner's consultant has prepared an Addendum to the Heritage Impact
Assessment in response to the peer review undertaken by Unterman, McPhail Associates. He
stated that another Addendum report should be prepared on the written submission of KNAD,
along with a revised building design. Mr. Willmer further advised that Parts 1-4 & 7 of the
Heritage Impact Assessment remain as they are regardless of the building design.
The Committee then discussed the KNAD request for notice of the public meeting. Mr.
Hermsen agreed to hold the requested meeting on June 20th; consequently, two weeks notice

given. Mr. Willmer agreed that his staff will give written notice of the public meeting and it was
agreed by the Committee that notice of the public meeting be given to all residents in the Victoria
Park Area Heritage Conservation District.
On motion by Councillor M. Galloway-
it was resolved:
"That consideration of Heritage Permit Application # 2002-V-03, submitted by Drewlo
Holdings Limited for the property municipally known as 530-540 Queen Street South be
deferred and referred to a special Heritage Kitchener meeting to be held on June
26, 2002; and further,
That City Council defer its consideration of Heritaqe Permit Application # 2002-V-03
to its meetinq to be held on July 2, 2002."
On motion by Mr. J. Clinckett -
it was resolved:
"That a public information meeting be held with the residents of the Victoria Park Area
Heritage Conservation District to allow them to examine newly revised building designs
proposed by Drewlo Holdings Limited for the property at 530-540 & 560 Queen Street
South, prior to consideration by Heritage Kitchener on June 26, 2002; and,
That notice of this public information meeting be circulated to all households in the
Victoria Park Area Heritage Conservation District and posted on the City's web site; and
further,
That any report prepared by Drewlo Holdings Limited or its consultants in this regard, be
made available to the area residents the day before the public meeting."
8. DESIGNATED HERITAGE PROPERTY GRANT PROGRAM
Mr. L. Bensason provided the Committee members with copies of a draft by-law to implement the
Heritage Property Grant Program, attached to which, as Schedule "A" to the by-law, was a
document title "Conditions and Administrative Procedures for the Awarding of Grants Pursuant
to the Designated Heritage Property Grant Program under S.39 of the Ontario Heritage Act."
Mr. Bensason requested that Committee members provide him with any comments they may
have in regard as soon as possible.
