Ziegler and M. Galloway OFFICIALS PRESENT: Ms. T. DeVille, Assessment Clerk Ms. L. MacDonald, Assistant City Solicitor Ms. S. Trantor Mr. D. Kerr, Engineering Technologist Mr. L. Neil, Assistant City Clerk Mr. U. Edernburgh, Design & Construction Engineer This meeting of the Court of Revision was called to consider any appeals respecting local improvement assessments for the construction of works in 1999 and 2000. Notice of the meeting had previously been given by mail to affected property owners and by newspaper advertisement. 1. APPOINTMENT OF A CHAIR On motion by Councillor J. Smola - It was resolved: "That Councillor J. Ziegler be appointed Chair of the Court of Revision for 2001." 2. LOCAL IMPROVEMENT WORKS The works and streets considered by the Court are the following: a) Sanitary Sewer & Connections -Strasburg Road, both sides, from Ottawa Street South to Chandler Drive. b) Sanitary Sewer & Connections -Glasgow Street, both sides, from 75m west of Knell Drive to 35m east of Westwood Drive. 3. DELEGATION -OTTAWA STREET SOUTH Messrs. Murray Huffman and Robert Mason, Mason Real Estate appeared as a delegation to appeal the local improvement charges of the property owned by 1210873 Ontario Limited in Trust situated at the north-west corner of Strasburg Road and Ottawa Street South. Mr. Huffman advised that the Regional Municipality of Waterloo had recently expropriated 3.079m from their Ottawa Street frontage, thus reducing the property frontage on Strasburg Road. The delegation also commented that quite some time age he had attended a preliminary site plan meeting and it was his recollection that the property could possibly have been serviced from Ottawa Street. Discussion took place regarding clarification of location of the existing sanitary sewers on Ottawa Street South and Mr. D. Kerr confirmed to the delegation that their property would only be serviceable from Strasburg Road. Finally, the delegation requested they be exempted from the cost of the work on the basis that the real beneficiary of this improvement was the developer of the former Best Pipe lands. Councillor J. Ziegler pointed out that they had also gained a serviced property. On motion by Councillor J. Smola - it was resolved: "That the assessment for sanitary sewer and connections on Strasburg Road against the lot (Roll #4-7-354) owned by 1210873 Ontario Limited In Trust be reduced by 3.003 m to 66.037 m, as a result of the Region of Waterloo having expropriated 3.079 metres of the property's Ottawa Street frontage; and further, That the reduction be added to the City share of the cost of the work." Galloway - It was resolved: "That balance of the assessments pertaining to local improvement charges considered by the Court this date be confirmed." 5.
