HomeMy WebLinkAboutAdjustment - 2006-02-14 SGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD FEBRUARY 14, 2006 MEMBERS PRESENT: OFFICIALS PRESENT: Messrs. P. Britton, B. Issac and Z. Janecki. Mr. B. Sloan, Senior Planner, Mr. R. Parent, Traffic & Parking Analyst, Ms. D. Gilchrist, Secretary-Treasurer, and Ms. T. Kraemer, Administrative Clerk Mr P. Britton, Chair, called this meeting to order at 10:35 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, February 27, 2006, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2006-003 Applicant: John Cloutier & Brian Chard Property Location: 148 Margaret Avenue Legal Description: Lots 451 & 454, Registered Plan 376, being Part 2, Reference Plan 58R-861 Appearances: In Support: Mr. B. Chard Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to install a wooden ground sign on the front lawn, to advertise a home business; whereas the Sign By-law only permits fascia signs to advertise a home business. The Committee considered the report of the City's Planning Division, dated February, 2006, advising they have no objections, on the understanding that the sign will be constructed generally in accordance with the plans submitted. The Committee considered the report of the Region of Waterloo Transportation Planner, dated February 6, 2006, advising they have no concerns with this application. Mr. B. Sloan advised that typically a ground sign for a home business would not be supported; however, this property is located in an Institutional zone, between two churches, both of which have ground signs. Further, any other use in an Institutional zone is permitted a ground sign. COMMITTEE OF ADJUSTMENT 5 FEBRUARY 14, 2006 1. Submission No.: SG 2006-003 (Cont'd Moved by Mr. Z. Issas That the application of John Cloutier & Brian Chard requesting permission to install a wooden ground sign on the front lawn, to advertise a home business; whereas the Sign By-law only permits fascia signs to advertise a home business, on Lots 451 & 454, Registered Plan 376, being Part 2, Reference Plan 58R-861, 148 Margaret Avenue, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. That the sign shall be constructed generally in accordance with the plans submitted with this application. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Sign By-law is being maintained on the subject property.
