HomeMy WebLinkAboutAdjustment - 2006-03-14 SGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD MARCH 14, 2006 MEMBERS PRESENT: OFFICIALS PRESENT: Ms. D. Angel and Messrs. D. Cybalski and B. Isaac. Mr. B. Sloan, Senior Planner, Ms. D. Gilchrist, Secretary-Treasurer, and Ms. R. Brent, Assistant Secretary-Treasurer. Mr D. Cybalski, Chair, called this meeting to order at 10:30 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, April 3, 2006, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2006-004 Applicant: Sunvest Realty Corp. Property Location: 842 Victoria Street North Legal Description: Lots 1 & 2, Registered Plan 929, being Part 1, Reference Plan 58 R-14849 Appearances: In Support: Mr. R. Baxter Mr. R. Smith Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to erect a pylon sign to be located 0.2m (0.6') from a parking area rather than 0.6m X1.96'), and permission for this pylon sign to have a concrete base, whereas the Sign By-law requires a clearance between the bottom of the sign and grade of 4.3m (14.1'). The Committee considered the report of the City's Planning Division, dated March 8, 2006, advising they have no objections, on the understanding that the owner will provide a landscape plan for updates the previously approved landscape plan that was provided for this Site Plan development) to indicate and implement appropriate landscape plantings in the area surrounding the proposed sign, to the satisfaction of the City's Director of Planning, prior to any issuance of a sign permit. The Committee considered the report of the Region of Waterloo Transportation Planner, dated February 25, 2006, advising they have no concerns with this application. The Committee considered correspondence from the Kitchener-Wilmot Hydro dated February 27, 2006, advising of safety standards established by Ontario Regulation 22/04, and the Occupational Health and Safety Act, for the benefit of the applicant. Submission No.: SG 2006-004 ~Cont'd) Mr. Baxter stated the building has a unique design, and they want the brickwork at the bottom of the sign to be in-keeping with the building, and also to be visible. The owner respects the safety concerns addressed in the sign by-law; however, they feel the sign is very visible, the required landscaping, and the fact that the sign is setback quite away from Victoria Street, will all address the safety issues. Moved by Ms. D. Angel Seconded by Mr. B. Issas That the application of Sunvest Realty Corp. requesting permission to erect a pylon sign to be located 0.2m (0.6') from a parking area rather than 0.6m X1.96'), and permission for this pylon sign to have a concrete base, whereas the Sign By-law requires a clearance between the bottom of the sign and grade of 4.3m (14.1'), on Lots 1 & 2, Registered Plan 929, being Part 1, Reference Plan 58R-14849, 901 Victoria Street North, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. That the sign as approved in this application shall be constructed generally in accordance with the plans submitted. 2. That prior to the issuance of a sign permit, the applicant shall submit an updated landscape plan to indicate and implement appropriate landscape plantings in the area of the proposed sign, to the satisfaction of the City's Director of Planning. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Sign By-law is being maintained on the subject property.
