HomeMy WebLinkAboutAdjustment - 2006-04-18 SGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OF THE REGULAR MEETING HELD APRIL 18, 2006 MEMBERS PRESENT: OFFICIALS PRESENT: Ms. D. Angel and Messrs. P. Britton and B. Isaac. Mr. B. Sloan, Senior Planner, Ms. D. Gilchrist, Secretary-Treasurer, and Ms. T. Kraemer, Administrative Assistant. Mr P. Britton, Chair, called this meeting to order at 10:05 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, May 8, 2006, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2006-005 Applicant: Alpine Hyundai Property Location: 44 Alpine Road Legal Description: Part dot 6, Registered Plan 1022 being Part Block L, Plan 1246, Reference Plan 58R-7826 As no one appeared in support or opposition of this application, the Committee generally agreed to defer its consideration of this matter to its meeting scheduled for Tuesday May 9, 2006. 2. Submission No.: SG 2006-006 Applicant: KFR Holdings Limited Property Location: 21 Third Avenue Le al Description: Lot 7, Registered Plan 254 Appearances: In Support: Mr. K. Amy Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to erect a canopy sign in a residential zone, to advertise a legal non-conforming business, whereas canopy signs are not permitted in residential zones. The Committee considered the report of the City's Planning Division, dated April 11, 2006, advising they have no objections, provided the sign is constructed generally in accordance with the plans submitted with the application. The Committee considered the report of the Region of Waterloo Transportation Planner, dated April 11, 2006, advising they have no concerns with respect to this application. Mr. Amy advised there is an existing sign on the building which will be removed so the front of the building can be renovated. COMMITTEE OF ADJUSTMENT 9 APRIL 18, 2006 Moved by Ms. D. Angel Seconded by Mr. B. Issas That the application of KFR Holdings Limited requesting permission to erect a canopy sign in a residential zone, to advertise a legal non-conforming business, whereas canopy signs are not permitted in residential zones, on Lot 47, Registered Plan 254, 21 Third Avenue, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. That the canopy sign as approved in this application shall be constructed generally in accordance with the plans submitted with this application. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Sign By-law is being maintained on the subject properly.
