HomeMy WebLinkAboutAdjustment - 2006-07-11 SGCOMMITTEE OF ADJUSTMENT FOR THE CITY OF KITCHENER MINUTES OFTHE REGULAR MEETING HELD JULY 11, 2006 MEMBERS PRESENT: OFFICIALS PRESENT: Messrs. D. Cybalski, Z. Janecki and Ms. D. Angel. Mr. B. Sloan, Senior Planner, Ms. D. Gilchrist, Secretary-Treasurer, and Ms. T. Kraemer, Administrative Assistant. Mr D. Cybalski, Chair, called this meeting to order at 10:02 a.m. This meeting of the Committee of Adjustment sitting as a Standing Committee of City Council was called to consider applications regarding variances to the City of Kitchener Sign By-law and Chapter 630 (Fence) of the City of Kitchener Municipal Code. The Committee will not make a decision on these applications but rather will make a recommendation which will be forwarded to the Committee of the Whole and Council for final decision. The Chair explained that the Committee's decisions with respect to sign variances are recommendations to City Council and not a final decision. He advised that the Committee's recommendations will be forwarded to City Council on Monday, August 28, 2006, at 7:00 p.m., and the applicants may register with the City Clerk to appear at the meeting if desired. NEW BUSINESS 1. Submission No.: SG 2006-011 Applicant: ~oblaw Properties limited Property Location: 875 Highland Road West Legal Description: Part Blocks A & F, Plan 1384 Appearances: In Support: Ms. I. Matte Contra: None Written Submissions: None The Committee was advised that the applicant requests permission to replace 3 pylon signs with pylon signs having the following variances: Sign Location: Highland Road -Variance s): Clearance of 1.47m (4.82') between the copy area of the sign and grade rather than 2.44m ~8'). Sign Location: Fischer Hallman Road -Variance s): Clearance of 1.8m (5.9') between the copy area of the sign and grade, with cladding in the clearance area, rather than 2.44m (8'). Sign location: Queen's Boulevard -Variance s): Clearance of 1.8m (5.9') between the copy area of the sign and grade, with cladding in the clearance area, rather than 2.44m (8'). The Committee considered the report of the City's Planning Division, dated July 5, 2006 advising they have no objections to this application. The Committee considered the report of the Region of Waterloo, Transportation Planner, dated June 22, 2006 advising they have no concerns with this application. The Committee considered the report of the Grand River Conservation Authority, Resource Planner, dated June 26, 2006 advising they have no object to the sign being erected on two pylons provided the space between the pylons remains open as indicated on the drawings provided. COMMITTEE OF ADJUSTMENT 21 JULY 11, 2006 1. Submission No.: SG 2006-011 (Cont'd Ms. Matte explained that the proposed signage is consistent with the branding of this store. She noted that for the Highland Road and Queen's Boulevard signs they will be using the existing concrete bases. The sign to be located on the Fischer Hallman Road frontage will have a new base. This sign is at a higher elevation and will not interfere with pedestrian or vehicular traffic. In response to comments from the Grand River Conservation Authority, Ms. Matte assured the Committee that the base for sign #1 will remain open. Moved by Mr. Z. Janecki Seconded by Ms. D. Angel That the application of Loblaw Properties Limited requesting permission: to replace the existing pylon sign on the Highland Road frontage with a pylon sign having a clearance of 1.47 m (4.82') between the bottom of the sign and grade, rather that the required 2.44 m ~8'); to replace the existing pylon sign on the Fischer Hallman Road frontage with a pylon sign having a clearance between the bottom of the sign and grade of 1.8 m X5.9'), with cladding in the clearance area, rather than a clearance of 2.44 m (8'); and, to replace a pylon sign on the Queen's Boulevard frontage with a pylon sign having a clearance between the bottom of the sign and grade of 1.8 m (5.9'), with cladding in the clearance area, rather than a clearance of 2.44 m (8'), on Part Blocks A and F, Plan 1384, 875 Highland Road West, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. That the variances as approved in this application shall apply to the pylon signs only as shown on the plans and drawings submitted with this application. It is the opinion of this Committee that: 1. The variance approved in this application is minor in nature. 2. This application is desirable for the appropriate development of the property. 3. The general intent and purpose of the City of Kitchener Sign By-law is being maintained on the subject properly.
