HomeMy WebLinkAboutCouncil - 2006-08-21 SSPECIAL COUNCIL MINUTES AUGUST 21, 2006 CITY OF KITCHENER A special meeting of City Council was held at 5:14 p.m. this date, Chaired by Mayor C. Zehr with all members present. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Council considered a request to enact a resolution consenting to Councillor M. Galloway serving on the Board of Directors of the Association of Municipalities of Ontario and its Committees. Moved by Councillor B. Vrbanovic Seconded by Councillor C. Weylie "That Kitchener City Council consents to Councillor M. Galloway serving on the Board of Directors of the Association of Municipalities of Ontario and its Committees and agrees to pay any costs associated with attendance at its meetings." Carried. Council considered a recommendation arising from the Finance and Corporate Services Committee meeting this date with respect to an exemption to Chapter 450 (Noise) of the Municipal Code to allow for an outdoor wedding reception at 75 Pinnacle Drive. Moved by Councillor M. Galloway Seconded by Councillor J. Gazzola "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to Pat Doerr for an outdoor wedding reception at 75 Pinnacle Drive on August 26, 2006, between the hours of 3:00 P.M. and 1:00 A.M." Carried. Council considered a recommendation arising from the Finance and Corporate Services Committee meeting this date with respect to an exemption to Chapter 450 (Noise) of the Municipal Code related to the Kitchener Youth Action Council's Unity Jam. Moved by Councillor G. Lorentz Seconded by Councillor C. Weylie "That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to the Kitchener Youth Action Council on Friday, August 25, 2006, between the hours of 5:30 P.M. and 11:30 P.M. for the 4th Annual Unity Jam to be held in the Civic Square." Carried. Council considered a recommendation arising from the Finance and Corporate Services Committee meeting this date with respect to a request to sell refreshments during Unity Jam in the Civic Square on August 25, 2006. Moved by Councillor C. Weylie Seconded by Councillor G. Lorentz "That the Kitchener Youth Action Council be approved to sell refreshments at the 4th Annual Unity Jam on August 25, 2006 on the Civic Square, provided the necessary licence, including Health and Fire approvals, is obtained." Carried. Council considered Corporate Services Department report CRPS-06-124 (D. Gilchrist), dated August 16, 2006, concerning Committee of Adjustment Submission No. SG 2006-012 to allow a sign on City property to advertise the Wilfrid Laurier University School of Social Work. Smola "That the application of the Corporation of the City of Kitchener requesting permission to locate a third party sign, advertising the Lyle S. Hallman Faculty of Social Work, Wilfrid Laurier University, on Duke St., Part Lot 5, Registered Plan 401 (Part of PIN 22317-0009 LT), being a triangular shape parcel of land, part of the Duke Street West right-of-way, adjacent to 120 Duke Street West, Kitchener, Ontario, BE APPROVED, subject to the following condition: 1. That Wilfrid Laurier University shall enter into an encroachment agreement with the City of Kitchener, to allow for the proposed sign on City property." Carried. Council considered Corporate Services Department report CRPS-06-121 (L. MacDonald), dated August 10, 2006, concerning an Encroachment Agreement request for a third party sign on City property adjacent to 120 Duke Street West. Moved by Councillor B. Vrbanovic Seconded by Councillor J. Smola "That subject to Committee of Adjustment recommendation and subsequent Council approval of a third party sign, the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with Wilfrid Laurier University to authorize the encroachment of a third party sign located on the Duke Street W. road allowance in front of 120 Duke St. W." Carried. Council considered correspondence dated August 17, 2006 concerning Tender T06-006 -Road Reconstruction -King Street (Rose Street to Lancaster Street). Moved by Councillor J. Smola Seconded by Councillor G. Lorentz "That Tender T06-006, Road Reconstruction, Krug Street (Rose Street to Lancaster Street), be awarded to J. Weber Contracting Limited, Breslau at their tendered price of $433,433.00, including provisional items and contingencies of $47,419.06 and G.S.T.; and further, That the Mayor and City Clerk be authorized to execute an agreement satisfactory to the City Solicitor." Carried. It was moved by Councillor M. Galloway, seconded by Councillor C. Weylie, that an in-camera meeting of City Council be held immediately following this special meeting to consider a personal matter, a land acquisition /disposition matter and two matters subject to solicitor-client privilege. Councillor J. Gazzola raised a concern regarding the appropriateness of Items 1, 2 & 3 listed on the in-camera agenda as matters for in-camera discussion. Mayor C. Zehr suggested and it was agreed that discussion on Councillor Gazzola's concerns would take place at the beginning of the in-camera meeting. A vote was taken on the motion authorizing the in-camera meeting and it was Carried. For the record, Council discussed the appropriateness of the items listed on the in-camera agenda and it was deemed that all items were in accordance with the Procedural By-law. The meeting then recessed at 5:18 p.m. and reconvened at 7:03 p.m. Chaired by Mayor C. Zehr and with all members present except Councillor G. Lorentz. Mayor C. Zehr inquired if any delegations were present with respect to the by-law listed on the agenda to close and sell part of the public lane between Wellington Street and Breithaupt Street. Smola "That leave be given the Mover and Seconder to introduce the following by-laws for three readings and that the same be taken as read a first, second and third times, be finally passed and numbered serially by the Clerk. (a) Being a by-law to close and sell part of the public lane that runs easterly from Weber Street West between Wellington Street and Breithaupt Street in the City of Kitchener. (b) To confirm all actions and proceedings of the Council. On motion, the meeting adjourned at 7:05 p.m. tBy-law No. 2006-157) tBy-law No. 2006-158)." Carried. MAYOR CLERK
