Weylie, Chair, with the following members present: Mayor C. Zehr and Councillors B. Vrbanovic, M. Galloway, G. Lorentz, J. Smola and J. Ziegler. Officials Present: Ms. L. MacDonald, D. Ross and Messrs. J. Fielding, G. Stewart, F. Pizzuto, J. Willmer, R. Browning, J. McBride, S. Turner, B. Sloan and L.W. Neil. 1. DTS-02-115 ACTIVE & SAFE ROUTES TO SCHOOL PROGRAM The Committee considered Development and Technical Services Department report DTS-02- 115 dated June 20, 2002 dealing with the Active and Safe Routes to School Program. On motion by Councillor J. Ziegler - it was resolved: "That the Active and Safe Routes to School (A.S.R.T.S) Program be endorsed including the use of the City logo on A.S.R.T.S literature." DTS-02-162 DAIMLER DRIVE AT BRIARMEADOW DRIVE INTERSECTION CONTROL CHICOPEE-GRAND RIVER WARD The Committee was in receipt of Development and Technical Services Department report DTS- 02-162 dated July 16, 2002 dealing with intersection control on Daimler Drive at Briarmeadow Drive. Councillor B. Vrbanovic expressed appreciation to traffic staff for the report as presented. On motion by Councillor B. Vrbanovic - it was resolved: "That an all-way stop control be installed at the intersection of Daimler Drive at Briarmeadow Drive/Briarmeadow Place; and, That the uniform Traffic Bylaw be amended accordingly; and, That staff continue to monitor traffic volumes and speeds on Daimler Drive and Briarmeadow Drive; and further, That the Waterloo Regional Police be requested to enforce the existing 50km/h speed limit on Daimler Drive." 3. DTS-02-163 CAMERON STREET BETWEEN WEBER STREET AND TROY STREET ON-STREET PARKING BRIDGEPORT-CENTRE WARD The Committee was in-receipt of Development and Technical Services Department report DTS- 02-163 dated July 15, 2002 dealing with on-street parking regulations on a portion of Cameron Street. On motion by Councillor J. Smola - it was resolved: "That parking be prohibited on the east side of Cameron Street from Weber Street to Troy Street; and, That parking be permitted for three (3) consecutive hours on the west side of Cameron Street between Weber Street and Troy Street; and further, That the Uniform Traffic By-law be amended accordingly." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 145 - CITY OF KITCHENER 4. DTS-02-165 OLD MILL ROAD BETWEEN PINNACLE DRIVE AND DOON VALLEY DRIVE SPEED LIMIT FAIRVIEW-GATEWAY WARD The Committee consi~'ered Development and Technical Services Department report DTS-02- 165 dated July 15, 2002 dealing with reduction of the speed limit on Old Mill Road. On motion by Councillor J. Ziegler - it was resolved: "That the speed limit on Old Mill Road between Pinnacle Drive and Doon Valley Drive be reduced to 40 km/h; and further, That the Uniform Traffic By-law be amended accordingly." DTS-02-157 OLD PARK LANE ON-STREET PARKING FOREST-ROCKWAY WARD The Committee considered Development and Technical Services Department report DTS-02- 157 dated June 14, 2002 dealing with revision to on-street parking prohibitions on Old Park Lane. On motion by Councillor G. Lorentz - it was resolved: "That the current 'No Parking Anytime, April 1 to July 31' prohibition on the north/south/east (odd-numbered) side of Old Park Lane from Highview Drive to a point 152 metres east thereof be replaced with 'No Parking 4:00 p.m. to 8:00 p.m., April 1 to July 31 '; and further, That the Uniform Traffic By-law be amended accordingly." DTS-02-169 ACTIVA AVENUE AT BUSHCLOVER CRESCENT / WILDERNESS DRIVE TRAFFIC CONTROL SOUTH WARD The Committee was in-receipt of Development and Technical Services Department report DTS- 02-169 dated July 24, 2002 pertaining to traffic control at the intersection of Activa Avenue at Bushclover Crescent / Wilderness Drive. Councillor M. Galloway commented that neighbourhood residents were appreciative of the recommendation; however, he pointed out that he had not received response from staff on requests that were forwarded during the last year and expressed hope that more interaction would take place in future. On motion by Councillor M. Galloway - it was resolved: "That an all-way stop control be installed at the intersection of Activa Avenue at Bush Clover CrescentNVilderness Drive; and further, That the Uniform Traffic By-law be amended accordingly." DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 146 - CITY OF KITCHENER 7. DTS-02-158 GLASGOW STREET BETWEEN WEST HILL GLASGOW STREET ROAD CLOSURE APPLICATION LA 02/01/G/SV WEST-VICTORIA PARK WARD DRIVE AND OLD The Committee was in-receipt of Development and Technical Services Department report DTS- 02-158 dated August 6, 2002 dealing with closure and sale of Glasgow Street between West Hill Drive and Old Glasgow Street. On motion by Councilor G. Lorentz - it was resolved: "That Road Closure Application LA 02/01/G/SV (Sunvest Development Corporation) be approved in principle, and that the Corporate Services Department be instructed to proceed with the preparation of a By-law and necessary advertising in the local newspaper for the closing of a portion of Glasgow Street that runs between West Hill Drive and the previously closed portion of Glasgow Street (west of Resurrection Drive), shown as Part 1 on the attached Reference Plan 58R-13625. The road closure is subject to the following condition: 1) That the purchasers be responsible for all costs related to survey, legal, registration and advertising associated with the closure of the road." DELEGATION - NEIGHBOURHOOD CONCERNS RE HOUSE OF FRIENDSHIP EXPANSION Ms. S. Gunz appeared in support of an e-mail she had sent to City staff dealing with the issue of concentration of social agency housing in the Cedar Hills area and a proposed expansion of the House of Friendship notwithstanding that they had explicitly stated that they had no further plans for expansion within the area. As background, Councillor J. Smola advised that the Downtown Advisory Committee had been scheduled to discuss this issue at a meeting last week but did not as the meeting was cancelled due to lack of a quorum. Ms. Gunz emphasized that their concern was over proliferation of social agency houses in the neighbourhood and that she was distressed at finding herself in the position of being opposed to the House of Friendship on this issue. She distributed a map outlining House of Friendship properties, social agency properties and rent geared to income housing within a very small area and displayed the map on the overhead projection screen. She also circulated a list of numerous social agency properties operating in the neighbourhood. Ms. Gunz stressed that the House of Friendship had previously said that they had no plans to purchase additional properties and she stated that there was an urgent need for a minimum distance separation between such agency facilities. Accordingly, she requested that the City become involved in this matter to discuss their concerns with House of Friendship officials. Mayor C. Zehr advised that he has made arrangements to meet with House of Friendship representatives and senior City staff and would attempt to determine what the issues were with respect to the additional property that House of Friendship was proposing to acquire. Mr. J. Willmer commented that a team of planning staff was currently looking at a variety of issues as it relates to the zoning by-law to which Ms. Gunz responded that zoning regulations did not reflect the outcome of the zoning. DTS-02-170 BRUCE STREET / FIFE AVENUE & CAMBRIDGE AVENUE / HEATHER AVENUE TRAFFIC CONTROL BRIDGEPORT-CENTRE WARD The Committee consi~'ered Development and Technical Services Department report DTS-02- 170 dated August 1, 2002 which recommends that all-way stop controls not be installed at the intersections of Bruce Street at Fife Avenue and Cambridge Avenue at Heather Avenue. Mr. J. McBride advised that staff had nothing further to add to the report; however, he did refer DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 147 - CITY OF KITCHENER the Committee to a submission and petition received from the neighbourhood in this regard. DTS-02-170 BRUCE STREET / FIFE AVENUE & CAMBRIDGE AVENUE HEATHER AVENUE TRAFFIC CONTROL BRIDGEPORT-CENTRE WARD (CONT'D) Mr. Joseph Soulier attended in opposition to the staff recommendation and in support of the submission and petition of area residents. He commented on the impaired vision resulting from the 30 degree curve of Bruce Street and Fife Avenue as well as the increasing number of children moving into the neighbourhood and requested that an all-way stop control be installed at the intersection of Bruce Street and Fife Avenue. He also commented on the results of the City's traffic study and the high volumes of traffic moving through the neighbourhood between 6 -7:30 am and 3 - 7pm, as well as speeding that takes place after 7pm. Mr. Robert Starr pointed out the staff report did not address traffic volumes that were cutting through the neighbourhood from River Road and racing for the light at the intersection of Bruce Street and Frederick Street. As well, he advised that the neighbourhood was also experiencing heavy truck traffic all of which was trying to access the ramp to the expressway on Bruce Street. Councillor J. Smola commented that in his opinion there was a major problem with speeding and safety issues within the neighbourhood and for that reason supported installation of two all-way stop controls. On motion by Councillor J. Smola - it was resolved: "That all-way stop controls be installed at the intersections of Bruce Street at Fife Avenue and Cambridge Avenue at Heather Avenue; and, That the Uniform Traffic By-law be amended accordingly; and further, That Transportation Planning continue to monitor vehicle speeds and through traffic concerns within the Rosemount Community." 10. DTS-02-159 539 BRIDGEPORT ROAD ZONE CHANGE APPLICATION ZC 021021BICB HOIKER INC. BRIDGEPORT-CENTRE WARD The Committee was advised of a zone change application submitted by Hoiker Inc. respecting the property known municipally as 539 Bridgeport Road. The purpose of the rezoning is to legalize an existing multiple dwelling (triplex) and to legalize zoning regulation deficiencies, being: a triplex use, minimum lot width and area requirements and the location of existing buildings. In this regard, the Committee considered Development and Technical Services Department report DTS 02-159 dated July 25, 2002 and a proposed by-law dated July 15, 2002 attached to the report. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. J. Willmer briefly explained the purpose of the report. He noted that staff were of the view that rear yard parking was the only option and to accomplish this the existing garage would have to be demolished to allow for access. He advised that staff had met with the applicant and were still in discussions as to what action to take to provide for the required parking. Ms. Helen Szymkiu who owns property adjoining the subject property attended to express concern that her existing boundary line fence would be damaged by vehicles accessing the rear yard of the property. She requested that if the garage was torn down that appropriate grading be done to ensure that any water run off from the applicants property was contained on it. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 148 - CITY OF KITCHENER 10. Mr. Robert Eby attended on behalf of the applicant and advised that he managed the subject property. BRIDGEPORT-CENTRE WARD (CONT'D) be checking mapping and turning dimensions to determine if access to the rear yard could be accommodated if only an existing post was removed rather than the garage. In response to Mayor C Zehr, Mr. J. Willmer advised that the issue was the radius to undertake a vehicular turning movement into the rear yard and that staff could address the matter at the next Council meeting. On motion by Councillor J. Smola - it was resolved: "That the following staff recommendation from report DTS-02-159 be deferred and referred to the Auqust 26, 2002 Council meetinq for consideration: That Zone Change Application ZC 02/02/B/CB (539 Bridgeport Road - Hoiker Inc.), to change the zoning on the subject lands, legally described as Plan 674 Lot 28, from Neighbourhood Shopping Centre Zone (C-2) with Special Regulation Provision 17R to Neighbourhood Shopping Centre Zone (C-2) with Special Use Provision 320U, be approved, in the form shown in the 'Proposed By-law' dated July 15, 2002 subject to readings of the By-law being withheld until the owner of the property has completed the following conditions: 1) 2) That the garage be demolished so as to allow the for the development of a rear parking area; and, That the owner of the property enter into a site plan agreement with the City, to be approved by the Manager of Design & Development, and that the site be developed in accordance with said plan." 11. DTS-02-167 LOWER DOON STUDENT HOUSING STUDY IMPLEMENTATION RECOMMENDATIONS MUNICIPAL PLAN AMENDMENT APPLICATION MP 02/09ITC/DR ZONE CHANGE APPLICATION ZC 02/24ITC/DR CITY INITIATED - LOWER DOON FAIRVIEW-GATEWAY WARD The Committee was advised that City initiated applications have been processed to amend the Municipal Plan and change the zoning of lands known as Lower Doon within the municipality. The proposed amendments are for the purpose of prohibiting duplexing in the Lower Doon area. These proposed amendments result from consideration of the comprehensive study that was undertaken to address specific matters relative to student housing in Doon and the recommendation resulting from the study. In this regard, the Committee considered Development and Technical Services Department report DTS-02-167 dated July 29, 2002 and a proposed zoning by-law dated July 18, 2002 attached to the report. Also, attached to the report was the document to amend the Municipal Plan. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Councillor C. Weylie, Chair, read the following statement: 'This is a Public Meeting under 'The Planning Act, 1996' to consider Municipal Plan Amendment Application 02/09/TC/DR Section 17 (45) of the Planning Act allows the Ontario Municipal Board to dismiss all or part of an appeal without holding a hearing if the appellant did not make oral submissions DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 149 - CITY OF KITCHENER 11. at a public meeting or did not make written submissions to the council before the plan was adopted and, in the opinion of the Board, the appellant does not provide a DTS-02-167 LOWER DOON STUDENT HOUSING STUDY IMPLEMENTATION RECOMMENDATIONS MUNICIPAL PLAN AMENDMENT APPLICATION MP 021091TClDR ZONE CHANGE APPLICATION ZC 021241TClDR CITY INITIATED - LOWER DOON FAIRVIEW-GATEWAY WARD (CONT'D) reasonable explanation for having failed to make a submission. In order to ensure the record includes all the names of those individuals who are making verbal submissions today for this Municipal Plan Amendment, please ensure that you clearly identify yourself before you begin your submissions and the Clerk will record your name for the record. If your name does not appear on the record, you may jeopardize any further involvement you wish to have in these matters. Any recommendation made by the Development & Technical Services Committee on these matters today will be considered by City Council on Auqust 26, 2002. If City Council adopts the amendments, they will proceed to the Regional Municipality of Waterloo who has the final approval authority for Municipal Plan Amendments. They are also the body to whom appeals are sent. Further information on these procedures is available from the City's Development and Technical Services Department or the Region's Department of Planning and Culture.' Ms. D. Ross commented that the staff report was the result of direction given by Council one year ago and she then proceeded to describe the makeup of the City team and the study process. She commented that the recommendation would assist in maintaining the integrity of Lower Doon and then reviewed the recommendations contained in the staff report. She commented on the duplexing amendment and noted that as a balance to the duplexing issue, three lodgers would still be permitted in any dwelling. Mr. Dimitri Nenkov attended in support of his August 5, 2002 submission that was circulated with the Committee agenda. Mr. Nenkov advised that he owns three houses in the area and asked that his written submission be taken as his comments respecting this matter. He made additional remarks in respect to zoning and duplexing and suggested that Council was disregarding the contribution of Conestoga College to the community by its actions in respect to this matter. He maintained that future students of the College should have an opportunity to live in close proximity to it. Mr. Jim Law advised that he had purchased his property because of the location of the College and the student population which could provide for a rental income. He pointed out that there was a landlord association representing the area but that no one had ever approached it. He commented that on the surface the establishment of a community neighbourhood association looked like a good idea but suggested that many property owners who would be members were opposed to the idea of students residing within the area. He indicated that he was willing to discuss specific complaints regarding student issues at the landlord association level. Mr. Law then remarked on the numbered recommendations in the staff report and in summary stated that restricting duplexing was wrong and that perhaps a more appropriate way of dealing with concerns would be through minor distance separation regulations. Mr. Roman Szydlowski attended in support of his July 31, 2002 correspondence that was distributed with the Committee agenda. His submission favours prohibition of duplexing for reasons outlined and discusses classes of homeowners and their interests within the area. He stated that he was in agreement with the proposed restrictions but listed various loop holes which would still allow for over crowding to take place in the area as a result of student population. For the record, it was noted that the Committee had received a copy of an e-mail submission with the agenda submitted by A. & M. Bramer advising of support for the nine recommendations in DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 150 - CITY OF KITCHENER the staff report. 11. DTS-02-167 LOWER DOON STUDENT HOUSING STUDY IMPLEMENTATION RECOMMENDATIONS MUNICIPAL PLAN AMENDMENT APPLICATION MP 02/09ITC/DR ZONE CHANGE APPLICATION ZC 02/24ITC/DR CITY INITIATED - LOWER DOON FAIRVIEW-GATEWAY WARD (CONT'D) For the record, the Committee was also in receipt of a copy of a submission distributed with the agenda that was received from Janice Corrall supporting the recommendations in the staff report and the proposed Municipal Plan and zoning amendments. Mr. Manuel Ferraz was registered but did not wish to make a presentation in respect to this matter. Mr. Randy Martin attended in support of the recommendations in the staff report and expressed appreciation to Council for its proactive approach to address neighbourhood concerns. No other delegations were registered respecting this matter. Councillor J. Ziegler indicated that he was in support of the recommendations in the staff report and commented on the past actions of City Council on the matter of duplexing; as well as the current status and indicated that following passing of the amendments that have been proposed, any property owner could request duplexing upon submission of the necessary applications in this regard. On motion by Councillor J. Ziegler - it was resolved: "That Council adopt the following recommendations as a result of the comprehensive study completed relative to student housing issues in Lower Doon: 1) That Report DTS-02-167 be accepted as the required study pursuant to Section 38 (1) of the Planning Act. 2) That the Enforcement Division continue its efforts to educate residents, landlords and students in the Lower Doon area, with respect to City bylaws, and enforcement procedures. 3) That the residents of Lower Doon create a neighbourhood association consisting of residents, landlords, students and college representatives to provide a basis for regular communication and problem resolution. City staff will participate in meetings on an "as needed" basis upon a request from the neighbourhood association. 4) That the Parking Division undertake the necessary surveys/studies with the neighbourhood in order to determine the most appropriate approach to regulating on street parking in Lower Doon by December 31,2002. 5) That Grand River Transit staff be requested to continue improvements to service for Conestoga College students. 6) That Conestoga College be requested to continue to make students aware of the existing Code of Conduct. 7) That the College be requested to work with City staff to develop a procedure to develop a rating/inspection procedure for units in the College Housing Registry by December 31,2002. 8) That Council give their general support to development applications, within close DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 151 - CITY OF KITCHENER 11. DTS-02-167 proximity to Conestoga College, that may provide additional housing for students outside of the Lower Doon study area. The approval of such applications shall be LOWER DOON STUDENT HOUSING STUDY IMPLEMENTATION RECOMMENDATIONS MUNICIPAL PLAN AMENDMENT APPLICATION MP 021091TClDR ZONE CHANGE APPLICATION ZC 021241TClDR CITY INITIATED - LOWER DOON FAIRVIEW-GATEWAY WARD (CONT'D) subject to regular circulation and review and will be recommended for approval only if considered by Planning staff to be appropriate development. 9) i) That Municipal Plan Amendment Application MP 02/09/TC/DR (Lower Doon - City Initiated) be approved, being an amendment to: a) Amend Part 3, Section 12, by adding Special Policy 38 as follows: 38. Notwithstanding the Low Density Residential Designation, on lands in Lower Doon, duplexes shall not be permitted and second dwelling units shall not be permitted in semi-detached houses. b) Amend Map 8 to include Special Policy Area 38, to the Lower Doon lands as shown on Schedule A attached to report DTS-02-167. It is the opinion of this Committee that approval of this Amendment to the Municipal Plan is proper planning for the City. ii) That Zone Change Application ZC 02/24/TC/DR (Lower Doon - City Initiated) requesting a change in zoning from R-3 and R-4 to R-3 and R-4 with Special Use Provision 319U, be approved in the form shown in the "Proposed By-law" dated July 18, 2002. It is the opinion of this Committee that approval of this application is proper planning for the City and is in conformity with a recommended Amendment (Lower Doon - City Initiated) to the City's Municipal Plan." 12. DTS-02-177 90 WOODSIDE AVENUE TEMPORARY USE PROVISION - ZONING BY-LAW WEST-VICTORIA PARK WARD The Committee was ~n receipt of Development and Technical Services Department report DTS- 02-177 dated August 7, 2002 submitted for information purposes only in respect to a request that had been made at the July 2, 2002 Council meeting for a zoning by-law interpretation with regard to the property known municipally as 90 Woodside Avenue. Mr. B. Sloan advised that the staff report analyses specific wording used in Zoning By-law 2001- 161 and commented on the intent of the by-law. He did note that the proposed use on the subject property was to be completely contained within the building that existed at the time of the passing of the by-law but that a large portion of the building had been demolished. He advised that residents were concerned about how the by-law would be enforced in respect to definitions and their interpretation. Ms. Heather Thomson attended in respect to this issue and commented on the excellent communications that have taken place between City staff and residents. She requested that: the Ministry of Environment, Environmental Bill of Rights Registry be checked weekly for any activity and that staff not wait for notification from the Ministry on any issue, the temporary use provision at 90 Woodside Avenue be deleted from the zoning by-law at the earliest opportunity, consultation continue between the City and residents and that informal consultations take place before any formal considerations by Committee or Council took place and that staff undertake discussions and questioning of Ministry of Environment staff in respect to any major issues. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES AUGUST 12~ 2002 - 152 - CITY OF KITCHENER 12. DTS-02-177 13. 90 WOODSIDE AVENUE TEMPORARY USE PROVISION - ZONING BY-LAW WEST-VICTORIA PARK WARD (CONT'D) Councillor G. Lorentz suggested that the requests of Ms. Thomson be formalized by means of a report and recommendation from staff in this regard. On motion by Councillor G. Lorentz - it was resolved: "That as a follow-up to Development and Technical Services Department report DTS-02- 177 (90 Woodside Avenue - Zoning By-law Interpretation) and the August 12, 2002 presentation of Ms. Heather Thomson, planning staff prepare a report for consideration at a future Development and Technical Services Committee meeting to formalize the following requests outlined by Ms. Thomson: a) to delete the temporary use provision at 90 Woodside Avenue from the zoning by- law at the earliest opportunity. b) to have staff continue a city / residents consultation process, including informal consultations before formal consideration of any issue involving 90 Woodside Avenue. c) to develop a standard process requiring consultation with and questioning of Ministry of the Environment Officials in respect to matters posted on the Ministry's Environmental Registry (EBR)." DTS-02-174 STRASBURG ROAD / BLOCK LINE ROAD REQUEST OF CYPRIOT HOMES TO WAIVE CITY DEVELOPMENT CHARGES ALL WARDS The Committee considered Development and Technical Services Department report DTS-02- 174 dated August 6, 2002 dealing with a request that has been received from Cypriot Homes to waive City development charges for affordable housing projects in like manner as the Region of Waterloo has done. It was noted in the report that staff are of the opinion that it would be appropriate to look at the merits of reduced residential development charges for affordable housing for the entire City in conjunction with the Community Improvement Plan Review to ensure there is a balanced approach to exemptions that meets the City's desire to have a mixture of housing types in all areas of the City. Mr. J. Willmer briefly summarized the purpose of the report and noted that Mr. C. McNabb has also submitted a similar request to that of Cypriot Homes. He emphasized that staff wished to deal with this matter on a comprehensive basis and were not in a position to do so on a piece meal basis. Mr. Chris McNabb attended along with Lee Brubacher on behalf of Spadina Apartments Seniors Residence to request a grant in lieu of development charges. Mr. McNabb advised that he was unaware a study was being undertaken by the City but that he had spent significant time working with the Region of Waterloo on this matter. He confirmed that a letter has been sent to the City requesting a grant and pointed out that their project was on a very tight budget. He asked that the City defer the fees until December as they were not in a position to pay them at this time with respect to their 27 unit one bedroom apartment project. Mayor C. Zehr commented that the City wants to encourage such development throughout the municipality but that the August 26, 2002 Council meeting would be the earliest date to deal with this matter. Councillor J. Grewal with respect to the property known municipally as 953 Doon Village Road. The purpose of the rezoning is to permit a multiple dwelling (triplex) and to expunge a no longer existent R-2D zoning category. In this regard, the Committee considered Development and Technical Services Department report DTS-02-160 dated July 19, 2002 and a proposed by-law dated July 8, 2002 attached to the report. It was pointed out that notice that the Committee would hold a public meeting this date to consider this matter had previously been given. Mr. J. Willmer briefly explained the purpose of the report and advised that staff had nothing further to add with regard to planning issues relative to the property. He did point out that staff would monitor on-street traffic to ensure occupants of the subject property comply with the parking requirements to prevent on-street parking. It was noted in the report that currently there was no process or requirement for a new group home to notify neighbouring residents prior to commencement of operation, unless a zone change or minor variance was required. On motion by Councillor J. Smola - it was resolved: "That the proposed amendment to Chapter 430 (Group Homes - Registration) of the Municipal Code to incorporate a notification procedure as part of the registration process for group homes be approved, in the form shown in the Proposed By-law attached to Development and Technical Services Department report DTS-02-168." 18. DTS-02-172 NOTIFICATION POLICY INSTITUTIONAL SITE PLANS The Committee was in receipt of Development and Technical Services Department report DTS- 02-172 dated August 6, 2002 in which staff recommend no action be taken with respect to the introduction of a notification policy for institutional site plan approvals. The report discusses the merits of introduction of a policy and suggests situations that would detract from the effectiveness of any notification policy and thereby counteract many of the customer service enhancements being introduced to the approvals process. Councillor B. Vrbanovic suggested that the matter be further discussed at a staff level as it had been his hope that a policy could be developed that was similar to group homes and thereby provide for some form of public notice. Mr. J. Willmer advised that if the issue was to be referred back to staff that he would like the opportunity to meet with Councillor Vrbanovic to fully explore his issues of concern and bring the matter back to a future Committee meeting. On motion by Councillor B. Vrbanovic - it was resolved: "That the matter of introduction of a notification policy for institutional site plan approvals (report DTS-02-172) be referred back to planning staff for discussion with Councillor B. Vrbanovic prior to preparation of a further staff report for consideration by the Development and Technical Services Committee in October 2002." 19. DTS-02-175 EQUIPMENT RENTAL AGREEMENT IN SUPPORT OF CONESTOGA COLLEGE PRE-SERVICE FIRE TRAINING PROGRAM The Committee considered Development and Technical Services Department report DTS-02- 175 dated August 12, 2002 prepared by D. Trask, Deputy Fire Chief. The report and recommendation deal with the Conestoga College delivery of a pre-service fire training program and the need to rent necessary equipment to train firefighters to Ontario Fire Services standards. The staff recommendation supports a memorandum of understanding signed by the City March 5, 2001 setting out the general agreement whereby the City, through its Fire Department in co- operation with Conestoga College would work together with the Ontario Association of Fire Chiefs and the Ontario Fire Marshall in delivering a revised model of the provincial pre-service training to prospective firefighters.
