HomeMy WebLinkAboutCRPS-06-006 - Delegation of Authority to Execute Data Exchange AgreementsReport To: Finance and Corporate Services Date of Meeting: January 9, 2006 Submitted By: Lesley MacDonald, Director of Legal Services and City Solicitor (Ext. # 2267} Prepared By: Lesley MacDonald, Director of Legal Services and City Solicitor Ward(s) Involved: N/A Date of Report: January 5, 2006 Report No.: CRPS - 06-006 Subject: Delegation of Authority for execution of Data Exchange Agreements RECOMMENDATION: The City Clerk be authorized to execute agreements satisfactory to the City Solicitor for the exchange of city information/data from or to the City of Kitchener with public agencies, educational institutions and all levels of government, which require the information for public or educational, non-commercial purposes, said release of any information to be in compliance with any legislative obligations. BACKGROUND: The City has received requests from the Universities for City generated information for educational purposes and requests from various government departments and the Region of Waterloo for City data to augment their information for specific projects. In addition, the City also requires information generated by the same parties as well as other public agencies such as the Grand River Conservation Authority and where appropriate has developed a reciprocal agreement for the exchange of information. EXECUTIVE SUMMARY: N/A REPORT: Staff review these requests to determine what information they can release and whether specific restrictions need to be placed on the use of information in addition to the restrictions that prohibits commercial use of the information. The City has developed a data exchange template that it uses as the foundation for agreements where possible, however, from time to 2 time, the City may be asked to execute agreements prepared by the party holding the information from whom the City is seeking information. These agreements are reviewed by Legal to ensure the City's interests are protected. FINANCIAL IMPLICATIONS: None. In some cases, the City reserves the right to charge for the information. COMMUNICATIONS: N/A CONCLUSION: Staff recognizes the advantage of exchanging information between the Universities and various levels of government and public agencies and wish to facilitate that exchange.
