Subject: Set Fines for Chapter 530 (Dogs) of The City of Kitchener
Municipal Code
RECOMMENDATION:
"That Council approve the short form wording and suggested set fine amounts for the offences
under Chapter 530 (Dogs) of The City of Kitchener Municipal Code, as set out in Schedule "A"
attached,
and further that the City Solicitor be authorized to submit this matter to the Regional Senior
Judge of the Ontario Court of Justice for the establishment of set fines."
BACKGROUND:
The City previously had short-form wording and set fine amounts for Chapter 530. This allowed
Provincial Offences Officers to issue tickets under Part I of the Provincial Offences Act. The
Municipal Act, 2001 requirements necessitated a repeal and replacement of our former dogs by-
law by January 1, 2005. The new dogs by-law 2004-265 was passed and has now been
incorporated into The City of Kitchener Municipal Code.
REPORT:
Report CRPS-04-227 to the Finance and Corporate Services Committee on December 6, 2004
referred to the Dogs By-law Review Committee's recommendation to obtain increased set fines
for some offences. The Dogs By-law Review Committee suggested amounts it felt appropriate
as set fines for several offences. Now that the new dogs by-law has been assigned numbering
in The City of Kitchener Municipal Code we can make application for these set fines.
The offences and suggested set fine amounts recommended to Council were determined by the
Dogs By-law Review Committee.
FINANCIAL IMPLICATIONS:
N/A
COMMUNICATIONS:
The Dogs By-law Review Committee is comprised of representatives from Council, the Dog
Designation Appeal Committee, Legal, By-law Enforcement, and the City's animal services
provider. Through the Committee these interested parties have been made aware of and
contributed to this recommendation.
CONCLUSION:
The Dogs By-law Review Committee has reviewed the suggested set fine offences and set fine
amounts and have no concerns.
