Subject: DECLARE LAND SURPLUS TO THE CITY'S NEEDS -135 &
139 VICTORIA STREET SOUTH
RECOMMENDATION:
That the parcels of land municipally known as 135 Victoria Street South, described as Part of
Lot 552, Registered Plan 378, designated as Part 1 on Reference Plan 58R-9666 and the land
municipally known as 139 Victoria Street South, described as Part of Lot 552, Grange's
Amended Survey, Registered Plan 378 in the City of Kitchener be declared surplus to the City's
needs; and,
That Legal Services be directed to transfer the said lands to the Parish of the Ukrainian Catholic
Church of the Transfiguration for the purpose of developing a parkette, at the price of $18,000,
plus incidental costs associated with this transaction; and further,
That the City retains easements over the said lands; and further,
That the Mayor and Clerk be authorized to execute the necessary documentation to complete
this transaction.
BACKGROUND:
The property municipally known as 139 and 135 Victoria Street South were purchased in 1994
and 1998 respectively for the installation of major trunk sewers. These two lots abut the
Ukranian Catholic Church of the Transfiguration property at 131 Victoria Street South.
The Pastor approached us requesting to purchase the vacant land to create a small serene
park.

REPORT:
The Property Management Committee discussed the request and came to the conclusion that
the land is not required for parking purposes and does not have much potential due to the
underground storm sewer encumbering the property. The committee supports the potential sale,
subject to retaining easements over the land.
An appraisal was complete by a licensed appraiser, resulting in an estimate of $28,343; $9,815
for #135 and $18,000 for #139. The Pastor was not prepared to purchase both parcels due to
cost. As a result, we negotiated with the Pastor and staff recommends that the sale of the two
parcels for $18,000.
Staff recommend this transaction recognizing that the lands cannot be developed due to
easements over large pipes. It is also important to appreciate that with the sale, the City will no
longer need to maintain this property. The Church indicates that they will develop a parkette.
This will be an improvement to the streetscape in that portion of Victoria Street.
FINANCIAL IMPLICATIONS:
All funds received by this transaction will be put into the Asset Management Reserve.
