Gosse, Director of Legislated Services Ward(s) Involved: 1 Date of Report: February 10, 2006 Report No.: CRPS-05-026 Subject: FORSYTH BUILDINGS -REQUEST FOR SPECIAL MEETING OF HERITAGE KITCHENER RECOMMENDATION: That Heritage Kitchener be requested to hold a special meeting prior to February 27, 2006, in order to consider the City of Kitchener's Heritage Permit Application regarding the Smyth Residence and the 1937 Art Deco addition to the Forsyth Building complex; and further, That Recommendations 4(c} and 5(a} of the Finance and Corporate Services Committee Report, dated February 13, 2006, be deferred to the February 27, 2006 Council meeting to allow Heritage Kitchener the opportunity to consider the City's Heritage Permit Application regarding the Forsyth property. BACKGROUND: Facilities Management staff on behalf of the City of Kitchener, were previously directed to submit a Heritage Permit Application to Heritage Kitchener regarding the demolition of the two remaining buildings on the Forsyth property being; the Smyth Residence and the 1937 Art Deco addition. Heritage Kitchener held a meeting on February 7, 2006 to consider the application but due to an emergency situation in City Hall, the Committee was unable to fully consider the application and was prevented from finishing its meeting. REPORT: The Ontario Heritage Act requires that Council, as the property owner, submit a Heritage Permit Application regarding the proposed demolition of the remaining designated structures. In addition Council, as the approval authority is required to consult with Heritage Kitchener (HK} regarding any demolition or alteration of a building designated under the Act. The City submitted the application, HK were to meet to consider and make recommendation(s) to Council and this would have constituted a consultation between HK and Council as the approval authority. During its meeting on February 7, 2006, HK had to adjourn its meeting due to an emergency situation in City Hall therefore they have not had an opportunity to consider the application and in turn could not make any recommendations to Council in time for the February 13th meeting. It is important that the Heritage Permit Application be dealt with no later than February 27, 2006 in order to not negatively impact the RFP process for the Centre Block property. It is also being suggested that two recommendations from the Finance and Corporate Services Committee for Council's consideration this date, be deferred as they relate to the demolition of the two buildings.
