Subject: SIGN BY-LAW AMENDMENT
RECOMMENDATION:
"That the draft by-law dated February 17, 2006, attached to Corporate Services Department
report CRPS-06-028, be adopted in order to have the City's Sign By-law 2005-194 apply to
property along Regional road corridors; and further,
That the Council of the City of Kitchener requests the Council of the Regional Municipality of
Waterloo to repeal its By-law 05-083, being a By-law to Prohibit or Regulate the Placing or
Erecting of any Sign, Notice or Advertising Device within 400 metres of any limit of a Highway
under the jurisdiction of The Regional Municipality of Waterloo."
EXECUTIVE SUMMARY:
BACKGROUND:
The Municipal Act, 2001 required the City's by-laws to be brought into compliance with its
provisions by January 1, 2006. On September 19, 2005, as part of our ongoing compliance
review, Council of the City of Kitchener requested that the Regional Municipality of Waterloo
pass a sign by-law effective December 31, 2005 with provisions mirroring those of the City of
Kitchener's sign by-law. The Region's by-law would apply in the geographic limits of Kitchener
to the corridors along Regional roads in which the Region has authority to enact sign by-laws.
The Region passed this by-law in accordance with our request. A provincial regulation has
recently been passed under the Municipal Act, 2001 that allows the City to again pass a sign by-
lawapplicable to all areas of the City including the Regional Road Corridors.
REPORT:
Staff proposes to repeal section 30 of the City's Sign By-law 2005-194 thus making the City of
Kitchener's by-law applicable to the entire City of Kitchener. The City's current by-law does not
apply to corridors along regional roads that are governed by the Region's By-law 05-083, a By-law
to Prohibit or Regulate the Placing or Erecting of any Sign, Notice or Advertising Device within
400 metres of any limit of a Highway under the jurisdiction of The Regional Municipality of
Waterloo. The proposed amendment will allow our current Sign By-law to apply to all areas in the
City of Kitchener and eliminate the necessity of the Region's mirroring by-law. This amendment
will not change any of the rules governing signs in the City of Kitchener, only the by-law under
which the rules are applied. The amendment also will not implement any changes currently being
canvassed, suggested, or considered through the City's ongoing Sign By-law review. It is the
City's intention that public consultation through our Sign By-law review be completed prior to
implementation of any changes to existing sign regulations.
FINANCIAL IMPLICATIONS:
The Region's present by-law provisions applicable to Kitchene
by the City of Kitchener at our own expense. The repeal of
increase enforcement or administration costs for the City.
