HomeMy WebLinkAboutCRPS-06-030 - Closure of a Portion of Solon Ave and Conveyance to Canadian EngineersReport To: Committee of the Whole Date of Meeting: February 27, 2006 Submitted By: Lesley MacDonald, Director of Legal Services and City Solicitor (Ext. # 2267) Prepared By: Lesley MacDonald, Director of Legal Services and City Solicitor Wards} Involved: NIA Date of Report: February 23, 2006 Report No.: CRPS - 06 - 030 Subject: Closure of a portion of Solon Avenue, and conveyance to Canadian Engineers RECOMMENDATION: "That the closure of a Part of Solon Avenue, an untraveled road allowance, identified as Reserve A, Plan 687, Part Farm Lot, Plan 589, as in 249123, except Part 2, Plan 58R-829, be approved in principle, and that Legal Services staff be instructed to prepare the required by-law; advertise said by-law in the newspaper; documentation and conveyance of all required easements, subject to completion of an Environmental Assessment, and Reference Plan, if required; and That all costs associated with the closing and conveyance of that portion of Solon Avenue are to be deducted from the sale proceeds of said part; and further; That the Mayor and Clerk be authorized to execute any documentation in this regard required by and to the satisfaction of the City Solicitor." EXECUTIVE SUMMARY: N/A BACKGROUND: In the course of the City selling land it owned situated between 79 Fergus Avenue and 101 Fergus Avenue, staff discovered a portion of road allowance known as Solon Avenue that has never been closed. 2 REPORT: In order to complete the transaction, said portion needs to be closed so that it may be conveyed in accordance with the Offer to Purchase received and accepted by the City from Canadian Engineers as set out in Report # CRPS-05-156. FINANCIAL IMPLICATIONS: Costs to advertise the by-law in the paper, Reference Plan and Environmental Assessment, if required, and documentation and conveyance of all required easements to be deducted from the sale proceeds. COMMUNICATIONS: N/A CONCLUSION: It is appropriate that the City undertake the closure of this portion of the road in order to convey it.
