Gosse, Director of Legislated Services/Deputy City Clerk Prepared By: Patricia Harris, Manager of Licensing Ward(s) Involved: 3 Date of Report: March 6, 2006 Report No.: CRPS-06-041 Subject: REQUEST FOR OUTDOOR FOOD AND MERCHANDISE VENDORS - DOON HERITAGE CROSSROADS -MAY 27, 2006 RECOMMENDATION: That the request of Doon Heritage Crossroads to invite three food vendors and approximately 5 merchandise vendors to operate at the Emergency Services Muster, Games and Parade on May 27, 2006, at 10 Huron Road, be approved, providing the necessary licence, including Health and Fire approvals, are obtained; and further; That the reduced fee of $37.40 be applicable. BACKGROUND: Chapter 549 of the City of Kitchener Municipal Code states that a Temporary Retail Market Licence is required for a show with 5 or more vendors selling their own goods or services. The licence fee is $374.00. Chapter 501 (Business Licensing Fees) in Section 501.2.4 states that where an application is made for a licence by a recognized, registered bona fide charitable organization, the fee to be paid shall be 10% of the fee that would otherwise be payable. In cases of doubt as to the application of this section, the Manager of Licensing shall refer the application to Council for a decision. In regards to this request, the "charitable" provision does not apply, as each merchandise vendor will keep the proceeds from any sales they make. Chapter 586 (Refreshment Vehicles) requires that no licence be issued for the sale of food on public property until Council's permission is obtained. Council has approved this event for the past several years. REPORT: Attached is a letter from Wendy Connell, Supervisor of Programs, Doon Heritage Crossroads, requesting permission for 3 food vendors and approximately 5 merchandise vendors to operate on May 27, 2006 during the Emergency Services Muster, Games and Parade at Doon Heritage Crossroads. Ms. Connell has advised that the proceeds from the sale of the food will be donated to the various programs that the Muster is supporting this year. The proceeds from the sale of the merchandise, emergency services memorabilia, will be kept by each of the vendors. FINANCIAL IMPLICATIONS: Reduction in revenue of $336.60.
