Subject: AGREEMENT WITH MINISTRY OFTRANSPORTATION -
AUTHORIZED REQUESTOR AGREEMENT
RECOMMENDATION:
That the Mayor and City Clerk be authorized to execute an Authorized Requestor Agreement
with the Ministry of Transportation relating to obtaining vehicle ownership information pursuant
to the Municipal Parking Tag Program.
BACKGROUND:
The City of Kitchener currently has an Authorized Requestor Agreement in place with the
Ministry of Transportation which supports the City's parking violations system. This agreement
allows the City to electronically access the Ministry's vehicle ownership database in order to
process parking infraction notices (parking tickets).
The Ministry is changing the way the information is delivered to its clients, from a modem based
system to a web based system. This change in the delivery method requires that a new
agreement be executed.
REPORT:
The agreement is substantially the same as the current agreement, save and except for the
method of delivering the information electronically to us.
The agreement has been reviewed by Legal Services and they have identified a couple of
concerns with regard to the wording of 2 provisions of the agreement. However, the Director of
Enforcement has made some inquiries with the Ministry with regard to the concerns that have
been raised. He has received an interpretation from the Ministry on these issues and is
satisfied with the response, in terms of potential impacts on the Division's operations. It should
be noted that the concerns identified relate to provisions that are also contained in the existing
agreement and there has been no impact on our relationship with the Ministry.
In addition, there is a risk associated with not entering into this agreement, which has a direct
impact on our ability to process parking tickets and the associated revenue and legislative
concerns.
FINANCIAL IMPLICATIONS:
There are no additional financial implications related to the execution of this agreement, beyond
that fee schedule that has been in place since 1995. These fees relate to the number of tickets
that are paid, based on using information obtained from the Ministry as part of the process.
COMMUNICATIONS:
No Corporate Communications required.
CONCLUSION:
The execution of this Authorized Requestor Agreement is required to ensure the continuous and
uninterrupted service provided by the Ministry of Transportation, as required to support the
City's parking violation processing system.
