Gosse, Director of Legislated Services/City Clerk Prepared By: Patricia Harris, Manager of Licensing Ward(s) Involved: 6 Date of Report: March 28, 2006 Report No.: CRPS-06-051 Subject: REQUEST FOR REDUCED FEE-JOSEPH SCHNEIDER HAUS -HERB FAIR AND PERENNIAL EXCHANGE, APRIL 29, 206AND HEART & HAND FESTIVAL-SEPTEMBER 16, 2006 RECOMMENDATION: That the licence fee for the Herb Fair and Perennial Exchange on April 29, 2006 and the Heart and Handwerk Event on September 16, 2006 taking place at the Joseph Schneider Haus be reduced to $37.40 for each event. BACKGROUND: Chapter 541 (Itinerant-Temporary Vendor Permanent-Temporary Markets) of the Municipal Code states in Section 549.1.5 that a Temporary Retail Market Licence is required for a show with 5 or more vendors selling their own goods or services. The licence fee is $374.00. Chapter 501 (Business Licence Fees) states in Section 501.2.5 that where an application is made for a licence by a recognized, registered bona fide charitable organization, the fee to be paid shall be 10% of the fee that would otherwise be payable. In cases of doubt as to the application of this section, the Manager of Licensing shall refer the application to Council for a decision. In regards to this request, the "charitable" provision does not apply, as each vendor will keep the proceeds from any sales they make. REPORT: Attached is a letter from Susan Burke, Manager/Curator of Joseph Schneider Haus requesting Council to reduce the required licence fee of $374.00 to the nominal fee of $37.40. This request has been granted each year, except in 2003 when the full licence fee was required. The Herb Fair and Perennial Exchange on Saturday, April 29, 2005 will involve approximately 5- 10vendors selling specialty herbs. The Heart & Handwerk event on Saturday, September 16, 2006 will involve approximately 15 vendors selling crafts and offering unique items for sale. Both sales will take place outside on the Museum grounds. The museum will raise funds by renting tables and space to the vendors and each vendor will sell their goods, retaining all monies from the sale. If the museum was conducting the sale, or instituted a system to process the sale through their gift shop, a licence would not be required, but as noted in the 2nd paragraph of Ms. Burke's letter, the museum does not wish to pursue this option.
