Subject: EXEMPTION TO CHAPTER 450 (NOISE) -ONTARIO
REALTY CORPORATION AT 200 FREDERICK STREET

RECOMMENDATION:
Council's direction is requested.
BACKGROUND:
Ontario Realty Corporation (ORC), the property management entity, for properties under the
jurisdiction of the Province, is undertaking a project of roof repairs at the Provincial Courthouse
at 200 Frederick Street North. The nature of the work is such that various courtrooms would be
rendered unusable if the work was to proceed during the daytime. Thus, there is the potential to
cause further delays to an already overburdened court system. As a result, ORC tendered the
project with terms that provided for much of the work to be done in the evenings and overnight.
Once the work began, noise complaints were received and the ORC was informed of the
provisions of the City's Noise By-law, relating to construction noise, that being only permitted
between the hours of 7 A.M. and 7 P.M.. As a result, the ORC has submitted a request for an
exemption from Chapter 450 (Noise). A copy of their request is attached.
REPORT:
As a result of the complaints registered, the ORC has had to take steps to limit any construction
that would cause excessive noise and much of the work has now been scheduled for during the
day on Saturdays and Sundays. According to the ORC, this move has resulted in an extensive
delay in completing the project, with the potential for neighbourhood disruption on weekends,
and significantly increased the overall cost of the project.
For this reason, they are requesting consideration of an exemption that would permit
construction noise up to mid-night from Monday to Thursday from April 4t" to April 13t". They
have compressed their schedule in order to resolve the issue of noise at night by the Easter
holiday weekend.
They have indicated that there will likely still be some work completed on weekends, during the
hours permitted by the By-law, in order to make up for lost time and to meet their compressed
schedule.
They have also agreed to look at changes to the contractors normal practices wherever possible
to try to limit the noise impact. This may include finding a power source on site to reduce the
need for gas powered generators.
FINANCIAL IMPLICATIONS:
None identified at this time.

CONCLUSION:
Given the nature of the complaints received, staff are looking for Council's direction with respect
to permitting the requested exemption to permit construction noise from 7PM to midnight,
Monday to Thursday, from April 4t" to April 13t", 2006.
