Subject: REQUEST TO CHANGE LIQUOR LICENCE CONDITONS
FOR RELAX AT 91 QUEEN STREET SOUTH AND OTHER
ESTABLISHMENTS
RECOMMENDATION:
That the Manager of Downtown Community Development be authorized to sign an amending
agreement with 1623315 Ontario Ltd. for the establishment called "Relax" located at 91 Queen
Street South changing condition #4 in their private agreement with the City to read "to stop
serving alcohol by 2:00 a.m. daily" instead of by 1:00 a.m. daily; and,
That the AGCO be requested to change the condition on the liquor license issued to 1623315
Ontario Ltd., for the establishment called "Relax" located at 91 Queen St. S. to allow for service
of alcohol until 2:00 a.m. daily; and further,
That the AGCO be requested to change the condition on any liquor licence issued to an
establishment in Kitchener prior to April 27, 2006 to allow service of alcohol until 2:00 a.m.
where that establishment has a condition of service of alcohol ending at 1:00 a.m imposed
because of its private agreement conditions with the City of Kitchener.
BACKGROUND:
The City has historically requested that restaurants stop serving alcohol by 1:00 a.m in its
private agreements with the establishments. That condition has been imposed by the AGCO
from time to time on liquor licences. However, this has not been done consistently and the
LLARC understands that this condition is not enforced by the AGCO in Kitchener.
Consequently, establishments that comply with the private agreement condition may be at a
competitive disadvantage with other establishments.
REPORT:
Recently Council, at the request of LLARC imposed the 1:00 a.m. private agreement condition
on the Relax establishment at 91 Queen Street South. Mr. Serguei Totikov, operator of this
establishment is requesting that Section 4 of the Agreement signed by himself, on behalf of the
applicant Corporation and the City of Kitchener be amended to read "to stop serving alcohol by
2:00 a.m. instead of 1:00 a.m.
Mr. Totikov is concerned that this condition will negatively affect his business operation as all
similar club operations in the City are permitted to serve alcohol until 2:00 a.m. Members of
LLARC have spoken with the Waterloo Regional Police and they have no concerns with this
condition being amended.
The LLARC Committee is of the opinion that they may have erred in requesting this condition as
it is standard across the Province to allow liquor licensed establishments to serve alcohol until
2:00 a.m. daily.
