Gosse Ward(s) Involved: n/a Date of Report: June 2, 2006 Report No.: CRPS-06-088 Subject: AMEND CHAPTER 197 -VOTE RECORDERS RECOMMENDATION: That Chapter 197 (Voting Recorders) of the Municipal Code be amended by removing reference to the specific voting system and company and deleting the clause requiring that a certified copy of this Chapter be sent to the Minister of Municipal Affairs. BACKGROUND: Section 42 of the Municipal Elections Act requires that if a municipality wishes to use voting and vote counting equipment such as optical scanning vote tabulators, it must be authorized by By- law. REPORT: Chapter 197 of the Municipal Code authorizes the use of alternate voting equipment and specifies the type being used and the manufacturer. In 2006 the City will be leasing centralized optical scanning equipment from Dominion Voting Systems and in future, other voting equipment, such as de-centralized tabulators, may be considered. This change in equipment and company requires that Chapter 197 be amended. Rather than specifying the type of equipment and the company it's being leased from, the proposed amendment is non-spcefic and general to include other types of equipment and does not specifically reference the company. This will eliminate the need to amend the Chapter in the future unless there is a change in how voting is conducted. The proposed amendment also eliminates the clause requiring that the Minister of Municipal Affairs be notified of the by-law; this is no longer a requirement underthe Act. R.
