Riordan, Administrative Assistant wards} Involved: 1 Date of Report: June 7, 2006 Report No.: CRPS 06-094 Subject: DECLARE LAND SURPLUS TO THE CITY'S NEEDS - PARTS 2, 3 AND 4 OF 58R-1054 - SHELDON AVENUE NORTH RECOMMENDATION: That Parts 2, 3 and 4 of 58R-1054 be declared surplus to the City's needs; and, That the land be conveyed to the registered owner of lands immediately adjacent for fair market value and including incidental costs associated with the transaction; and further, That the Mayor and Clerk be authorized to execute the necessary documentation to complete the conveyance. BACKGROUND: Staff reported to Council in Report CRPS 05-164 to declare a portion of these lands surplus with a view to convey the said lands to the neighbouring property owner for the purposes of development. The remnant parcel is encumbered with substantial pipes; therefore, the City proposed to retain these lands for ongoing maintenance of the sewers. REPORT: In ongoing negotiations with the neighbour, it became apparent that in fact, it would be in the City's best interest and the neighbouring property owner's to consider the conveyance of the entire parcel. City engineers are satisfied that retaining an easement over the lands to the east of Part 2 on the draft plan herewith attached will meet their future needs to maintain the pipes. The City has retained Mr. Peter Benninger to negotiate the sale of the encumbered and unencumbered parts to ensure that the City gets fair market value. Page 2 June 7, 2006 Council's approval will allow the transaction of Parts 2, 3 and 4 of Reference Plan 58R-1054 in two Parts to be described on a plan to be registered, subject to this approval. Notice to the public is given by way of listing on the CounciUCommittee of the Whole agenda. We are recommending the sale of property be a direct sale to the abutting property owner. FINANCIAL IMPLICATIONS: Funds received from this sale of the site will go into Asset Management Reserve. COMMUNICATIONS: n/a CONCLUSION: n/a L.
