W.. RECOMMENDATION: That the following resolution be placed before Council at its meeting scheduled for July 4, 2006, namely: "That, subject to obtaining all necessary staff approvals and the payment of all required licence fees, the Mayor and Clerk be authorized to execute an Encroachment Agreement satisfactory to the City Solicitor, with the owner of The Olive & Bean Co., located at 276 King Street West, for the operation of a sidewalk patio along King Street West and Water Street North, for a period not to commence prior to execution of the Agreement by all parties and such use to terminate no later than October 31, 2006." REPORT: Legal Services is in receipt of a request to operate a sidewalk patio for the 2006 season along King Street West and Water Street North in connection with the proposed restaurant The Olive & Bean Co. to be located at 276 King Street West. Since this request is for a new patio, the matter is being brought before the Committee for its consideration. The restaurant is not open to date, however, the owner would like to have approval in place for the patio for such time as the restaurant is operational and there will be no delays in waiting for approval from Committee and Council due to the upcoming summer schedule. FINANCIAL IMPLICATIONS: N/A COMMUNICATIONS: N/A CONCLUSION: The appropriate staff has reviewed this request and have noted required changes. Should changes be made to staff's satisfaction, staff is supportive of the general concept of a patio at this location. In addition, as the plans for the restaurant have not yet been finalized, it is premature for final approval of the patio. Once the restaurant plans have been accepted by the City, staff will work with the owner to modify the patio proposal in order that the patio setup be acceptable to the City.
