RECOMMENDATION: "That upon compliance with Chapter 630 (Fences) of The City of Kitchener Municipal Code and removal of large rocks in the City's boulevard, subject to the approval of City staff, that the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory to the City Solicitor, with the owner(s) of the property municipally known as 38 Westwood Crescent, for a wooden fence and landscaping located on the City's road allowance." REPORT: I am in receipt of a request from the owners of 38 Westwood Crescent to legalize an existing wooden fence and landscaping, consisting of a stone garden which has a retaining wall and various bushes and plant material, located on the City's road allowance. Staff has reviewed this request and support the encroachment request subject to the wooden fence being brought into compliance with Chapter 630 (Fences) of The City of Kitchener Municipal Code and the removal of large rocks on the City's boulevard. The wooden fence is to be no higher than 3' from the sidewalk to the front of the house. FINANCIAL IMPLICATIONS: N/A COMMUNICATIONS: N/A CONCLUSION: The appropriate staff has reviewed this request and has noted required changes. Upon compliance with Chapter 630 and removal of the stones from the City's boulevard, staff supports the legalization of the existing encroachment of the fence and landscaping.
