Subject: AMENDMENT TO CHAPTER 630 (FENCES)
RECOMMENDATION:
That a by-law be enacted to amend the definition of a "swimming pool" as contained in Chapter
630 (Fences).
BACKGROUND:
Currently, Chapter 630 (Fences) requires that anyone wishing to install a swimming pool on
their private property must obtain a permit prior to doing so. The permit and inspection process
ensures that the pool is properly protected by fencing and gates. The Chapter defines a
swimming pool as a body of water that is a minimum of 36 inches in depth.
REPORT:
Staff have noticed an increase in the use of large, above ground, inflatable swimming pools and
questions have arose as to whether these pools require permits in the same manner as the
conventional style of backyard pools. Staff are suggesting that the Chapter be amended to
define a swimming pool as a structure that is designed and capable of holding a minimum of 36
inches of water. In doing so, staff would not run into difficulties with interpreting issues where
the pool does not currently hold 36 inches of water but can do so.
FINANCIAL IMPLICATIONS:
None identified at this time.

CONCLUSION:
Staff are recommending to amend the definition of "swimming pool" in Chapter 630 (Fences) to
avoid interpretation issues with respect to the new styles of swimming pools that may be
available for sale to the public.
