Subject: EXEMPTION TO CHAPTER 450 (NOISE) - CONESTOGA
STUDENTS INC.
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
Conestoga Students Inc. for an outdoor concert at Conestoga College on Tuesday September
12, 2006, between the hours of 6:00 P.M. and 11:00 P.M.
BACKGROUND:
Conestoga Students Inc. is planning their 2nd annual outdoor concert on Tuesday September
12t", in the parking lot of Conestoga College. There will be a live band playing, thus there is the
potential for loud noise. As such, the organization has applied for an exemption to Chapter 450
(Noise). A copy of their request is attached.
REPORT:
The organizers have provided a site plan map to show that the event is being held in a parking
lot that is located a distance from any adjacent residential area. In addition, they will be
positioning the stage to direct the music away from any residential area. The organizers are
also distributing flyers to the closest of the residential dwellings providing some advance notice
of the event.
Last year this event was held in a similar fashion and the By-law Enforcement office is not
aware of any complaints received with respect to the concert music.
FINANCIAL IMPLICATIONS:
None identified at this time.
COMMUNICATIONS:
No Corporate Communications required.
CONCLUSION:
Based on the circumstances surrounding this event, the By-law Enforcement Division does not
object to this request for an exemption.
