Subject: ENCROACHMENT AGREEMENT REQUEST -PROPOSED
DECK OVER STORM SEWER EASEMENT AT 66 ORCHID
CRES.
RECOMMENDATION:
"That the Mayor and Clerk be authorized to execute an Encroachment Agreement, satisfactory
to the City Solicitor, with the property owner(s) and any mortgagee(s) of Part Block 21,
Registered Plan 1822 designated as Part 63 on Reference Plan 58R-10109 (PIN 22727-0238
LT), municipally known as 66 Orchid Crescent, to legalize the installation of a deck to be located
approximately 1.8m x 6.7m, more or less, onto an easement registered as Instrument Number
1275400, more or less, said Agreement to be registered on title, if possible."
REPORT:
I am in receipt of a request to legalize a proposed deck to be located onto a storm sewer
easement registered as Instrument Number 1275400. The deck will be built directly off the right
hand side of the property owner's house and will be approximately 1.8m in width and 6.7m in
length.
Engineering Services has no objection to the installation of the proposed deck over the
easement. They have noted that the sewer is located at a depth running between 2 to 3 metres.
Engineering Services advised that if the deck needs to be removed in order to perform any work
on the sewer, it is the homeowners' responsibility to pay and arrange for removal of the deck
and installation of a replacement deck.

CONCLUSION:
The appropriate staff has reviewed this request and has no concerns with the location of the
proposed deck.
