Subject: REQUEST TO AMEND CHAPTER 533 OF THE MUNICIPAL
CODE (DRAIN LAYER)
RECOMMENDATION:
That staff prepare a by-law to amend Chapter 533 of the Municipal Code (Drain Layers) to add
a definition fora "Master Drain Layer; and further
That staff initiate the required public process with respect to the amending by-law.
BACKGROUND:
The City of Kitchener has licensed Drain Layers since 1973. A drain layer is currently defined in
Section 533.1.2 "as a person engaged in the laying of drains on private property between the
property line, or in the case of a water main, between the property line or shut off box, and a
point not more than 0.609 metres (2 feet) inside the outside wall of a building. The City currently
requires that anyone laying drains must obtain a licence.
REPORT:
Recent discussions between Licensing staff and Building staff regarding all the trades licensing
by-laws has resulted in a number of changes being recommended. Currently anyone laying
drains in the City must obtain a licence and if required by the Chief Building Official write and
pass an examination to determine whether they are qualified to act as a drain layer.
It is staff's opinion that a definition should be added into the by-law fora "Master Drain Layer".
A Master Drain Layer would be a person who is skilled in the planning, superintending and
laying of drains. They would have a regular place of business in Ontario and who, himself, or by
drain layers under his supervision lays drains.
The City would then require only Master Drain Layers to obtain licences and to write an exam if
the Chief Building Official deemed it was necessary to determine qualifications.
FINANCIAL IMPLICATIONS:
The Municipal Act requires that a public meeting be held before passing a licensing by-law and
that notice be given to allow the public an opportunity to make comment. The notice in this case
will be in The Record at an estimated cost of $500.00 and will include information regarding
several other licensing by-law amendments.
