Subject: EXEMPTION TO CHAPTER 450 (NOISE) - K-W
OKTOBERFEST EVENTS
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
K-W Oktoberfest Inc. for a series of events being held at various clubs between October 6t" and
October 14t", 2006, as outlined in the letter from K-W Oktoberfest Inc., dated August 2, 2006,
attached to Report CRPS-06-143, with the exception of the event being held at the Kitchener
Memorial Auditorium Complex on October 12, 2006.
BACKGROUND:
K-W Oktoberfest Inc. is requesting an exemption to Chapter 450 (Noise) of the City's Municipal
Code for a series of events that are being held at 8 clubs, during the 2006 Oktoberfest
festivities, running from October 6t" to 14t", 2006. A copy of their request is attached.
REPORT:
Staff within the By-law Enforcement Division report that the number of noise complaints relating
to these events over the past several years has been minimal at best. Typically, there appears
to be a large a degree of acceptance by City residents to these events, given their vast
popularity and broad community benefits. The level of cooperation that staff have received
from event organizers has been positive.
Having said this, concerns were raised with respect to one event that was held at the
Karlsberghaus Hall, coordinated by the Kiwanis Club, at the Auditorium last year. Specifically,
the event involved aHip-Hop night designed to appeal to a new and younger audience.
Given the concerns raised last year, a series of discussions and meetings have been held,
involving City staff, the Kiwanis Club, the event organizers and area residents, aimed at finding
a reasonable solution to address the concerns. The event this year is being held on October
12t", and at the time of the writing of this report, it was agreed that further discussions with all
parties are necessary to reach consensus.
As such, staff are recommending that this particular event be separated from the series of
events that are subject to this exemption request. A further report relating to this particular
event will be presented to Council at a future meeting.
FINANCIAL IMPLICATIONS:
None identified at this time.

CONCLUSION:
Based on the circumstances surrounding this request, the By-law Enforcement Division does
not object to this request for an exemption, subject to the exclusion of one event being held at
the Memorial Auditorium on October 12, 2006. A report dealing with this particular event will be
presented to Council at a future date.
