HomeMy WebLinkAboutCRPS-06-149 - Exemption to Chapter 450 (Noise) - Downtown Street Cleaningl K KR Corporate Services REPORT Report To: Finance and Corporate Services Committee Date of Meeting: October 2, 2006 Submitted By: Troy Speck, General Manager of Corporate Services Prepared By: Shayne Turner, Director of By-law Enforcement Wards} Involved: Wards 1 and 6 Date of Report: September 27, 2006 Report No.: CRPS-06-149 Subject: EXEMPTION TO CHAPTER 450 (NOISE) -DOWNTOWN STREET CLEANING RECOMMENDATION: That an exemption to Chapter 450 (Noise} of the City of Kitchener Municipal Code be granted to permit the Community Services Department, through an independent contractor, to undertake cleaning of the streets and sidewalks in the Downtown Core between the hours of 10 PM and 6 AM on various dates between October 2 and October 6, 2006. BACKGROUND: The Community Services Department is planning to undertake the fall program of street cleaning in the Downtown Core. This cleaning is done during the overnight period due to the pedestrian and vehicular traffic issues. The equipment used for this cleaning can cause higher that normal levels of noise. As such, Community Services is requesting an exemption from Chapter 450 (Noise). REPORT: The power washing project will be undertaken over the course of 5 nights. It is currently being planned to start on October 2nd. Staff advise that the contractor will make their best efforts to keep the noise levels as low as possible, however there may be noise levels that will be noticeable to some people. This type of cleaning has been routine in the past, both in the spring and fall. The City has received limited complaints in the past, which were mitigated by staff when they explained the necessity of the project and its, short duration. Over the past year, there is no record of complaints received. FINANCIAL IMPLICATIONS: None identified at this time. COMMUNICATIONS: No Corporate Communications required. CONCLUSION: Based on the circumstances surrounding this event, the By-law Enforcement Division does not object to this request for an exemption. Shayne Turner Director of By-law Enforcement
