DTS-06-153 - MARGARET AVENUE - NO STOPPING The Committee considered Development and Technical Services Department report DTS-06- 153, dated October 10, 2006, regarding the removal of no stopping on both sides of Margaret Avenue from Breithaupt Street to the westerly City limit. Councillor Smola directed that "No Stopping" remain on that portion of Margaret Avenue between Wilhelm Street and Louisa Street because of the difficulties at the school and bus stop in that area. On motion by Councillor J. Gazzola - it was resolved: "That the Uniform Traffic By-law be amended to remove the current "No Stopping (4:30 p.m. to 5:30 p.m., Monday -Friday)" regulation on both sides of Margaret Avenue from Breithaupt Street to the westerly City limit except for that portion of Margaret Avenue between Wilhelm Street and Louisa Street." 2. DTS-06-155 - BIEHN DRIVE I CARYNDALE DRIVE - TRAFFIC CONTROL The Committee considered Development and Technical Services Department report DTS-06- 155, dated October 11, 2006, regarding traffic control at the intersection of Biehn Drive and Caryndale Drive. On motion by Councillor J. Gazzola - it was resolved: "That the Uniform Traffic By-law be amended to include an all-way stop at the intersection of Biehn Drive and Caryndale Drive." 3. DTS-06-152 - RETENTION OF ENGINEERING CONSULTANT FOR LOWER HIDDEN VALLEY SANITARY SEWAGE PUMPING STATION The Committee considered Development and Technical Services Department report DTS-06- 152, dated October 17, 2006, regarding retention of an engineering consultant for Lower Hidden Valley Sanitary Sewage Pumping Station. DTS-06-152 - RETENTION OF ENGINEERING CONSULTANT FOR LOWER HIDDEN VALLEY SANITARY SEWAGE PUMPING STATION tCONT'D) On motion by Councillor J. Gazzola - it was resolved: "That the normal procedure for selection of Consultants be waived, and Stantec Consulting Limited be retained as our Engineering Consultant to undertake the design, contract administration, and inspection for the Lower Hidden Valley Sanitary Sewage Pumping Station." 4. DTS-06-154 - TEMPORARY OCCUPANCY REQUEST - 690 KING STREET WEST DAVID HAGHANI The Committee considered Development and Technical Services Department report DTS-06- 154, dated October 4, 2006, regarding a temporary occupancy request for 690 King Street West. On motion by Councillor J. Gazzola - it was resolved: "That enforcement of the City's Zoning By-law be waived with respect to a personal service use (alternative health practitioner) within a building existing on October 23, 2006, and temporary occupancy be approved subject to the personal service use vacating the location in the event the City initiated Zone Change (ZC06/06/TC/RM) to permit personal service uses on the subject lands in combination with other permitted uses is not approved; and further; That in the event of failure to vacate, the City's Municipal By-law Enforcement Officer be directed to commence notice of action to remove the illegal use and that any work done to the premises be at the sole risk and responsibility of the owner in the event losses are incurred as a result of final disposition of this application." 5. DTS-06-15$ - DEMOLITION CONTROL APPLICATION DC 06I10IHILT - 542 HIDDEN VALLEY ROAD - ONTARIO MINISTRY OF TRANSPORTATION The Committee considered Development and Technical Services Department report DTS-06- 158, dated October 17, 2006, regarding a demolition application for 542 Hidden Valley Road. On motion by Councillor J. Gazzola - it was resolved: "That Demolition Control Application DC 06/10/H/LT requesting permission to demolish one single detached dwelling located at 542 Hidden Valley Road, owned by the Ontario Ministry of Transportation, legally described as Lot 10, Registered Plan 1523, be approved without conditions." 6. DTS-06-130 - ZONE CHANGE APPLICATION ZC 05I17IDIBB - 46$ DOON SOUTH DRIVE LOTCO LIMITED The Committee considered Development and Technical Services Department report DTS-06- 130, dated October 16, 2006, regarding Zone Change Application ZC 05/17/D/BB to change the zoning on the lands at 468 Doon South Drive. Mr. Willmer explained that the purpose of this zone change is to allow freehold townhouses on a private street instead of a public street. Each townhouse is intended to be on a separate lot to be tied to other parcels of land for common use as part of a Common Elements Condominium. Scheels, GSP Group, attended this meeting on behalf of the applicant, in support of the staff recommendation. On motion by Councillor M. Galloway - it was resolved: "That Zone Change Application ZC05/17/D/BB, Lotco Limited, to change the zoning on the subject lands at 468 Doon South Drive from Residential Six Zone (R-6) to Residential Six Zone (R-6) with Special Regulation Provision 447R, on lands legally described as Block 2, Registered Plan 395 in the City of Kitchener, be approved in the form shown in the "Proposed By-law", dated July 24, 2006, attached to Development and Technical Services Department report DTS-06-130, without conditions." 7. DTS-06-147 - ZONE CHANGE APPLICATION ZC 06I19IVIAP - 72 VICTORIA STREET SOUTH - WATERLOO WAREHOUSE EQUITIES VICTORIA LIMITED The Committee considered Development and Technical Services Department report DTS-06- 147, dated October 3, 2006, regarding Zone Change Application ZC 06/19/V/AP to change the zoning on the lands at 72 Victoria Street South. On motion by Mayor C. Zehr - it was resolved: "That Zone Change Application ZC06/19/V/AP (Waterloo Warehouse Equities Victoria Limited) to change the zoning from Warehouse District Zone (D-6) with Holding Provisions 39H and 43H to Warehouse District Zone (D-6) with Holding Provision 43H on lands legally described as Lots A to H inclusive, Registered Plan 421, Lot 34 and Part Lots 35 and 41, Registered Plan 420, Part Lot 25, Streets and Lanes, municipally known as 72 Victoria Street South, in the City of Kitchener, be approved in the form shown in the "Proposed By-law", dated September 22, 2006, attached to Development and Technical Services Department report DTS-06-147." DTS-06-141 - DEMOLITION CONTROL APPLICATION DC 06I03IOIAP - 453 OTTAWA STREET SOUTH - CONCORDIA CLUB The Committee considered Development and Technical Services Department report DTS-06- 141,dated October 16, 2006, regarding a demolition application for 453 Ottawa Street South. Councillor Lorentz requested that this application be approved without conditions. He advised that the Concordia Club is proceeding to develop another seniors' housing apartment building similar to those they have already constructed on this site. On motion by Councillor G. Lorentz - it was resolved: "That Demolition Control Application DC06/03/O/AP requesting permission to demolish one single detached dwelling, located at 453 Ottawa Street South, legally described as Part of Lot 24, Plan 791, and as shown as Part 1, Reference Plan 58R-1437, be aggroved, without conditions." DTS-06-151 -CIVIC CENTRE HERITAGE CONSERVATION DISTRICT STUDY FINDINGS & APPROVAL TO PROCEED WITH PREPARATION OF THE HERITAGE CONSERVATION DISTRICT PLAN CRPS-06-151 -HERITAGE KITCHENER RECOMMENDATION RE CIVIC CENTRE HERITAGE CONSERVATION DISTRICT The Committee considered Development and Technical Services Department report DTS-06- 151,dated September 28, 2006, regarding Civic Centre Heritage Conservation District Study DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES OCTOBER 23, 2006 - $3- CITY OF KITCHENER 9. DTS-06-151 -CIVIC CENTRE HERITAGE CONSERVATION DISTRICT STUDY tCONT'D) Findings and Approval to Proceed with Preparation of the Heritage Conservation District Plan. The Committee also considered Corporate Services Department report CRPS-06-151, dated October 11, 2006, regarding a recommendation from Heritage Kitchener for the Civic Centre Heritage Conservation District. Mr. L. Bensason and the consulting team who prepared the Heritage Conservation District Study, consisting of: Ms. Maureen Zunti, Stantec Consulting Inc., Lead Consultant, Mr. Richard Coombs, Nexus Architects, Ms. Shannon Baker and Mr. David Waverman, Ecoplans, and Mr. Michael Baker, Historian, presented the contents of the study, and recommendations. Upon questioning Ms. Zunti advised there are some contemporary buildings in the study area and some vacant lands, and it will be necessary for the heritage conservation district plan to include guidelines or policies to guide their future development or redevelopment. With respect to the Mixed Use Corridor on Victoria Street and Water Street, it is intended that these properties remain within the boundary at this time; however, delineation of the final boundary will be subject to further study and analysis. Ms. Zunti also advised there are two potential risks for this area at this time: a potential increase demand for student housing, and development pressures based on activities taking place in Downtown Kitchener. The inclusion of the Victoria Street properties is not definitive at this time, as further analysis is required; however, designation appears to be warranted due to the consistency in the age and architectural style of the buildings. As the City is undertaking a Mixed Use Corridor study, it may be appropriate to mesh these policies with the heritage conservation district plan. Further, it is appropriate for the heritage conservation district plan to recommend changes in zoning. The plan may also make recommendations respecting both sides of Victoria Street. Also, the north side of Weber Street is in the study boundary, but the plan may make recommendations for properties on the south side of Weber Street. Mayor Zehr then advised he has received a letter from the Architectural Conservancy of Ontario (ACO). Mr. Bensason advised of the public consultation and communications undertaken through the period of preparation of this study, and, although typically the ACO doesn't normally form part of this process, they are more than welcome to participate. Councillor Weylie questioned the type of heritage lighting to be used in this district. Mr. Bensason advised that the final report will include data on the costs of the various types of lighting being recommended. On motion by Councillor B. Vrbanovic - it was resolved: "That the findings and recommendations of the Civic Centre Neighbourhood Heritage Conservation District Study dated September 2006 prepared by the consultant team led by Stantec Consulting Ltd. be accepted, and the Civic Centre Neighbourhood Heritage Conservation District Plan be prepared for Council's consideration in Spring 2007." DTS-06-156 - FINAL DOWNTOWN DESIGN POLICIES MUNICIPAL PLAN AMENDMENT MP 06I07ITCICB The Committee considered Development and Technical Services Department report DTS-06- 156, dated October 18, 2006, regarding Municipal Plan Amendment Application MP 06/07/TC/CB, Downtown Design Policies. Councillor C. Weylie, Chair, read the following statement: This is a Public Meeting under 'The Planning Act, 1996' to consider Municipal Plan Amendment Application MP 06/07/TC/CB Section 17 (45) of the Planning Act allows the Ontario Municipal Board to dismiss all or part of an appeal without holding a hearing if the appellant did not make oral submissions at a public meeting or did not make written submissions to the council before the plan DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES OCTOBER 23, 2006 - $4- CITY OF KITCHENER 10. DTS-06-156 - FINAL DOWNTOWN DESIGN POLICIES tCONT'D) was adopted and, in the opinion of the Board, the appellant does not provide a reasonable explanation for having failed to make a submission. In order to ensure the record includes all the names of those individuals who are making verbal submissions today for this Municipal Plan Amendment, please ensure that you clearly identify yourself before you begin your submissions and the Clerk will record your name for the record. If your name does not appear on the record, you may jeopardize any further involvement you wish to have in these matters. Any recommendation made by the Development & Technical Services Committee on these matters today will be considered by City Council on October 30, 2006. If City Council adopts the amendments, they will proceed to the Regional Municipality of Waterloo who has the final approval authority for Municipal Plan Amendments. They are also the body to whom appeals are sent. Further information on these procedures is available from the City's Development and Technical Services Department or the Region's Department of Planning and Culture. Mr. C. Bluhm advised that since the last Development and Technical Services Committee meeting, staff have made 2 minor revisions to the policies: the first addresses Mr. J. MacDonald's comments about street centric design, and the second relates to the request of the Region of Waterloo giving flexibility around future rapid transit stations. Mr. Bluhm advised these design policies are standards we are asking people to live up to. These policies provide the physical framework and general design principles, which are meant to be flexible, yet provide a district flavour. On motion by Councillor B. Vrbanovic - it was resolved: "That Municipal Plan Amendment Number 64 (MP06/07/TC/CB) be adopted, in the form shown in the "Proposed Municipal Plan Amendment" attached to Development and Technical Services Department report DTS-06-156, to introduce new general urban design policies for Downtown Kitchener, and accordingly forwarded to the Region of Waterloo for approval; and further, That "Design Brief DB-5 -Downtown Design Districts", be adopted and incorporated into the City's Urban Design Manual, in the form shown in the "Design Brief" attached to Development and Technical Services Department report DTS-06-156; to provide a graphical version of the Downtown Design District policies, as contained in section 9.3 of the Design Brief." 11. DTS-06-157 - TRAFFIC CALMING UPDATE The Committee considered Development and Technical Services Department report DTS-06- 157, dated October 18, 2006, regarding an update on traffic calming. Mr. K. Carmichael reviewed the report, noting that although Council's policy is to undertake traffic calming measures in 3 locations each year, a fourth location, Homewood Avenue has been added to the list in 2006 because it is scheduled to be reconstructed in 2006. Councillor Gazzola noted his frustration with the delay for receiving approval for the Environmental Assessment from the Ministry for the Kingswood Drive traffic calming measures. Noting that approval is not expected until the end of this year, he questioned if anything could be done to speed up the process. Staff suggested that the Mayor and Council could contact the area MPP and ask him to contact the Minister. Ms. Ladd also advised that she is involved in an association of Chief Administrative Officers who are working with the province to review regulatory framework, and one of the first things to be addressed is the Environmental Assessment Act and also Brownfields. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES OCTOBER 23, 2006 - $5- CITY OF KITCHENER 11. DTS-06-157 - TRAFFIC CALMING UPDATE tCONT'D) Councillor Lorentz questioned why the speed humps haven't been installed on Greenbrook Drive. Mr. Carmichael responded that the temporary measures have been installed, further, it takes a year before a proper review can be done. He also advised that the Emergency Services are opposed to speed humps as they reduce response time and lead to more frequent and costly repairs to emergency vehicles. Mr. Browning advised that in the near future a report will be presented to Council from all the Emergency Services addressing their concerns with speed humps being installed on City streets. Councillor Gazzola noted that several all-way and 3-way stops were installed on Deer Ridge Drive last year, and no complaints have been received. Mr. Carmichael responded that unwarranted all-way stop controls can negatively affect the operations of an intersection, reducing its efficiency, and increasing the potential for vehicle and/or pedestrian collisions. Unwarranted all-way stops also have a variety of impacts on society, the environment and the economy. On motion by Councillor B. Vrbanovic - it was resolved: "That Development and Technical Services Department report DTS-06-157 -Traffic Calming Update, be received for information." 12. DTS-06-159 - ENHANCED FAIRWAY ROAD ENTRANCEWAY FEATURES - CITY INITIATED The Committee considered Development and Technical Services Department report DTS-06- 159, dated October 23, 2006, regarding enhanced Fairway Road entranceway features. Councillor Vrbanovic commented that the Region should be requested to provide better designs for significant roadways in each municipality. On motion by Councillor B. Vrbanovic - it was resolved: "That Development and Technical Services Department report DTS-06-159 -Fairway Road Bridge Project and Development of Adjacent Lands, be received for information; and, That the Regional Municipality of Waterloo be requested to consider the Fairway Road Extension and Bridge as a roadway of significance, and to design it in an appropriate fashion; and further, That the Regional Municipality of Waterloo be requested to consider the construction of similar roads in other municipalities in the Region in a similar fashion." 13. RECOMMENDATION FROM ENVIRONMENTAL COMMITTEE - 45$5 KING STREET EAST Councillor Vrbanovic brought forward a recommendation from the Environmental Committee meeting of October 19, 2006, respecting a black walnut tree on the property municipally known as 4585 King Street East. On motion by Councillor B. Vrbanovic - it was resolved: That consideration of the following recommendation from the Environmental Committee be deferred and referred to the Council meeting of November 27.2006: "That in accordance with the requirements of Kitchener's Tree Management Policy, the owners of 4585 King Street East and the Site Plan Review Committee endeavour to retain the 50-year-old Black Walnut tree located in the northwest corner of the subject property, directly adjacent to the intersection of Limerick Drive and King Street East."
