RECOMMENDATION:
That Zone Change Application ZC OS/22/F/DR (Robert & Bryan Kieswetter) to change the
zoning from Convenience Commercial Zone (C-1) with Special Use Provision 321 U and Holding
Provision 49H to Convenience Commercial Zone (C-1) with Special Use Provision 321 U on
lands legally described as Lot 3 Registrars Compiled Plan 1470, municipally known as 1201
Fischer Hallman Road, in the City of Kitchener, be approved in the form shown in the attached
"Proposed By-law", dated December 05, 2005.
REPORT:
The subject lands are located at 1201 Fischer Hallman Road. The applicant is proposing to
rezone the property for the purpose of removing Holding Provision 49H. Holding Provision 49H
was placed on the property through a previous rezoning as the Region had identified the subject
lands as being contaminated and had requested submission of a Record of Site Condition. A
holding provision was included in the zoning on the subject lands until a Record of Site
Condition (RSC) had been completed and acknowledged by the Ministry of the Environment.
There are policies in the Municipal Plan which provide for holding provisions until environmental
work is completed. A RSC has since been completed and acknowledged by the Ministry of the
Environment and the Region has indicated that they have no objections to the removal of the
holding provision.
FINANCIAL IMPLICATIONS:
Nil
COMMUNICATIONS:
Notice of the public meeting to be held by the Committee of Council Dealing with Development
and Technical Services matters on January 9, 2006 will be advertised in The Record on
December 16, 2005.
CONCLUSION:
Based on the foregoing, the Department of Development and Technical Services recommends
that Zone Change Application ZC05/22/F/DR for lands at 1201 Fischer Hallman Road, be
approved in the form shown in the Proposed By-law.

BY-LAW NUMBER
OF THE
CORPORATION OF THE CITY OF KITCHENER
(Being a by-law to amend By-law 85-1, as amended,
known as the Zoning By-law for the City of Kitchener -
Kieswetter - 1201 Fischer Hallman Road)
WHEREAS it is deemed expedient to amend By-law 85-1;
NOW THEREFORE the Council of The Corporation of the City of Kitchener
enacts as follows:
1. Schedule No. 93 of Appendix "A" to By-law 85-1 is hereby amended by deleting
the holding symbol and numerical reference thereto (49H) as such symbol and
numerical reference relate to the lands described as Lot 3, Registrar's Compiled
Plan 1470, in the City of Kitchener, and zoned Convenience Commercial Zone
(C-1) with Special Use Provision 321U. These lands are shown on Map No.1
attached hereto.
2. Appendix "F" to By-law 85-1 is hereby amended by deleting section 49 therefrom.
