Subject: VICTORIA STREET SOUTH — WALNUT STREET TO
LAWRENCE AVENUE RECONSTRUCTION, REGION OF
WATERLOO — NOISE BY -LAW EXEMPTION
RECOMMENDATION:
That the Regional Municipality of Waterloo and its contractor(s) be exempt from the
provisions of Chapter 450 Noise of the City of Kitchener Municipal Code Article 6
Construction Work during the reconstruction of Victoria Street South from Walnut Street
to Lawrence Avenue in the City of Kitchener. The request for the noise by -law exemption
is between the hours of 7:00 p.m. to 7:00 a.m. for the period from April 3, 2006 to October
31, 2006.
BACKGROUND:
John Lee, Project Manager for the Regional Municipality of Waterloo, sent an email request
dated January 27, 2006 for an exemption to be granted to the noise bylaw. In order to complete
the work and minimize traffic disruption for this project, some weekend work must take place in
order to complete the project in the time allotment. This exemption is requested in order to
work until 9:00 p.m. as required to complete the work, and to advise of required weekend work.
REPORT:
The limits of construction for this project include Victoria Street South from Walnut Street to
Lawrence Avenue in the City of Kitchener. This project will commence on April 3, 2006 and is
scheduled to continue until approximately October 31, 2006.
The scope of the contract includes the following staging:
• Stage 1 —West Avenue to Patricia Avenue —early April to mid June
• Stage 1 A —West Avenue to Iron Horse Trail —early April to mid May
• Stage 1 B —Iron Horse Trail to Patricia Avenue —early May to mid June
• Stage 2 —West Avenue to Walnut Street —mid June to late July
• Stage 3 — Patricia Avenue to Belmont Avenue —late July to mid September
• Stage 4 — Belmont Avenue to Lawrence Avenue —mid September to late October
Before completion of each construction stage, the road will be paved and fully opened to two-
way traffic.
The noise exemption request includes the need for four (4) weekends of work during the
construction period. This will incorporate the work within the intersections to minimize
intersection closure times and improve traffic flows once the work has been completed. One of
the weekends will be July 7 -9, 2006 at the intersection of Victoria Street South and Walnut
Street, for railway work and the pipe crossing of the railway. The other three (3) weekends will
be for the construction of deep sewers and watermains at the intersections of Patricia Ave
(Stage 3), Belmont Avenue (Stage 3) and Lawrence Avenue (Stage 4). An Open House was
held by Regional staff in November 2005 detailing the proposed reconstruction of Victoria Street
South to advise the public of the extent of the work.
Noise protocol will be followed, which covers administrative measures such as scheduling of
noisy activities at times of least impact, selection of haulage routes to minimize close proximity
to neighbours, and maintaining contact with residents.
The request for a noise exemption will permit the Regional Municipality of Waterloo and its
Contractor(s) to complete their work in a safe and efficient manner under the limit set out in the
contract. In order to limit the impact on the nearby residential areas, the contractor will be
required to comply with requirements for equipment maintenance and operation, in that the
contractor is obligated to maintain all equipment in proper working order including proper noise
reduction.
FINANCIAL IMPLICATIONS:
None.
COMMUNICATIONS:
The Regional Municipality of Waterloo and its contractor will communicate the expectation of
extended working hours to area residents and have been actively advising of any changes as
they develop.

CONCLUSION:
In order to expedite the construction and allow extended hours of work to take place for this
project, thereby minimizing traffic impacts on Victoria Street South, we recommend that this
request for a noise by -law exemption be granted.
