Subject: PLAN OF SUBDIVISION 30T -98204 (WOODHURST COURT)
EXEMPTION FROM COUNCIL POLICY I -1120 (SIDEWALKS)
RECOMMENDATION:
That Council waive the standard sidewalk requirement for this Plan of Subdivision, in favour of a
modified sidewalk location, as set out in the attached request from the subdivider (Lotco
Limited).
BACKGROUND:
A previous Council direction permitted the re- zoning of the subject lands from Commercial
Zoning (C -1) to Residential (136). At that time, staff recommended against the zone change, due
to a number of factors, including the potential difficulties with extending sanitary sewers to the
subject lands. The subdivider has now proceeded with servicing the lands, however, the existing
sanitary sewer within Westforest Trail was found to be approximately 0.6 metres higher in
elevation when it was exposed. In order to service the residential units by gravity, the subdivider
has proposed to raise the elevation of the subject site.
The grade changes now necessary to service these lands will result in steep grade transitions
along sections of the planned sidewalks, which may pose a risk to the public. The subdivider
has proposed a solution that provides sidewalks across the Westforest Trail frontage, and a
connection through the centre portion of the cul -de -sac. This proposal would see the deletion of
the planned sidewalks fronting Lots 1 thru 9.
A copy of the subdivider's request is attached for your information.
FINANCIAL IMPLICATIONS:
Fundin
As this is a developer initiated project, no City of Kitchener funding is required.
CONCLUSION:
It is the opinion of staff that an exemption from Council Policy 1 -1120 is warranted in this
instance. The grade transitions necessary to service the subject lands would represent a
considerable risk to the public, and would continue to be a long -term maintenance concern in
the future.
