CEMETERY BY-LAW REVISIONS 2006
RECOMMENDATION:
That the draft by-law dated March 30, 2006, attached to CSD Report 06-053 be adopted in
order to amend Chapter 210 (Cemeteries - Municipal) of the City of Kitchener Municipal
Code and further;
That staff be directed to forward the amending by-law to the Registrar appointed
pursuant to the Cemeteries Act (Revised) for approval.
BACKGROUND:
REPORT:
The proposed by-laws have been drafted to facilitate several changes. These changes are
primarily housekeeping in nature and reflect a simplification of wording for easier maintenance
of the by-laws and to assist customers to understand the intent of a by-law.
· 10.7.9 - revises the number of cremation interments allowed on an adult grave space from
maximum of (4) to a maximum of (3), so that there is consistency throughout the cemeteries.
· 120.7.18 - revises the awkward wording of the section to simplify the intent of the by-law for
customers.
· 21 0.9.8 - revises the wording of this section pertaining to private shrubs, to simplify the
content. There is no change to the intent of the by-law.
· 21 0.9.1 0 - revises the date that customers must remove wreaths on stands, placed on
graves, previously from May 1 S\ now starting April 15th. This change was necessitated due
to shorter and milder winters, resulting in much earlier grass cutting dates.
· 21 0.1 0.2 - revises this section to account for the inclusion of some bronze markers within a
specific area of Williamsburg Cemetery.
· 21 0.1 0.5 - eliminates reference to specific sections that are no longer relevant to the by-law.
· 21 0.1 0.12 - revision to permit allowable embellishments on an upright marker to a maximum
of two, made of either bronze or granite. Prior to this change, no embellishments were
allowed. This by-law was questioned by monument dealers and staff feel that the revision is
reflective of the needs of the customer.
· 210.10.13 - facilitates the placement of the flat markers in a new section at Woodland
Cemetery.
· 210.11.1 - amends the section to add that monuments are subject to the approval of the
Manager. This was added to ensure that monuments that are of questionable design from a
safety or aesthetic perspective can be reviewed by the Manager.
· 210.11.4 - discusses foundation depth and installation. This material is redundant to the
Cemeteries Act.
· 210.11.14 - provides sizing specification for monuments erected on Children's lots
· 210.14.2 - is a simplification to the existing wording and does not change the intent.
· 210.16.6 - is further clarification that the bronze dedication plague will be attached to the
reflection stone.
· 210.16.7 - was redundant. The requirements for Sanctuary Woods are explained in Section
210.7.9
· 210.16.8 - revises the acceptable memorial from one bronze dedication plague to one
granite pillow marker.
The attached revised bylaw has been reviewed by Legal and they are in support.
FINANCIAL IMPLICATIONS:

COMMUNICATIONS:
The public has been notified of proposed changes through signage posted at the entrance to all
City of Kitchener cemeteries and through a notice in the Record, dated April 13, 2006. The local
monument dealers have received a copy of the proposed draft by-laws. On those issues
pertaining directly to monuments, the monument suppliers were invited to directly participate in
drafting the requirements.
