KOR GALLERY AND STUDIOS
RECOMMENDATION:
For information only.
BACKGROUND:
Previous reports to Committee and Council regarding the wind-down of the KOR Gallery and
Studios contained information about the pending sale of its material assets. This report is
intended to update the Community Services Committee on the disposition of these assets. The
sale of assets closed on Monday, February 27,2006 at which time the sealed bids were opened
and successful buyers notified.
In a March 28, 2006 telephone conversation and in e-mail correspondence dated May 11, 2006,
KOR representatives Mark Garner and Carl Clappison brought staff up to date on the results of
the wind-down operation. KOR representatives used telephone and e-mail methods exclusively
to confirm that asset distribution had been completed. This effectively means the end of KOR
Gallery and Studio organizational operations.
REPORT:
Further to CSD-06-031 (February 27, 2006), KOR representatives have reported the following
resolution of the closing down of KOR Gallery and Studios:
1) Unsecured creditors were paid with the proceeds of the sale of assets and KOR
representatives stated that they were not aware of any additional debts, with the
exception of the City of Kitchener's outstanding unpaid utility bill in the amount of
$6,353.51 ;
2) Unsold equipment still in useable condition and stored in a secure room at the Joseph
Street facility was given to ROOF;

3) John Deboer, the artist who donated three art works to KOR, was given the option by
KOR representatives to re-claim them, and subsequently he removed them from the
Joseph Street property under the safety supervision of City staff.
Staff requested written confirmation of the KOR board's closing, dispersal of assets, and
repayment of creditors. Such confirmation has been received, as stated above, in the form of
electronic mail only.
The General Manager of Financial Services has been consulted with regard to the outstanding
utility bill. The G.M. has recommended the utility bill be included as an uncollectible account
receivable.
Finally, staff discovered that another artist's works were placed by KOR representatives in a
City storage facility along with other items. These artworks were returned to this artist on May
18, 2006.
FINANCIAL IMPLICATIONS:
The $6,353.51 outstanding utility bill will be included in the next Uncollectible Accounts
Receivable listing provided for Council's consideration.
COMMUNICATIONS:
From December 2005 to the end of March 2006, staff has provided the Arts and Culture
Advisory Committee with monthly updates. ACAC was able, through its network of influence, to
provide assistance to the KOR board of directors with the preservation of its archives and
facilitated the completion of the board's exhibition commitments.
CONCLUSION:
This report confirms the close-down of KOR Gallery and Studios is complete with the exception
of the few administrative actions outlined above.
