C Weylie) Date of Report: Report No.: Subject: November 7,2006 DTS-06-165 MINOR ZONE CHANGE APPLICATION ZC06/22/I/JB Ira Needles Blvd. 30T -02-205 Silvestri Investments RECOMMENDATION: That Zone Change Application ZC06/22/I/JB for the purpose of changing the zoning from Hazard Land Zone (P-3) to Arterial Commercial Six (C-6) on lands legally described as Part of Lot 38, GCT, being Parts 1, 2, and 4 on Registered Plan 58R-1501 0 and to change zoning from Arterial Commercial Six (C-6) to Open Space (P-2) on lands legally described as Part 3 of 1 Registered Plan 58R-1501 0 and Parts of 58R-14862 in the City of Kitchener be aDDroved in the form shown in the attached "Proposed By-law", dated November 7, 2006 without conditions. BACKGROUND: The subject lands are on the west side of Ira Needles Blvd., north of Highland Rd., and were part of the original Stage 2 of the Draft Plan Approved Subdivision 30T-02205 (Silvestri- Highland West). A stormwater management facility was to be constructed at the southern portion of Stage 2. The Region required lands from the subdivider for Ira Needles Blvd. and a stormwater management facility (that was previously considered for the adjacent Hydro lands, but no longer feasible). The Region and the applicant have now agreed to relocate the stormwater management facility to another block of land on the subject site, legally described as Part 3 of 58R-15010 and Parts of 58R-14862. The Draft Approved Plan of Subdivision was modified to remove the stormwater management facility and Ira Needles Blvd. lands that were dedicated to the Region. Due to the relocation of the lands for the stormwater facility, the original site for the facility can be rezoned to Arterial Commercial Zone (C-6) consistent with the rest of Stage 2 and, at the same time, the new stormwater management facility can be zoned Open Space (P-2) instead of C-6. REPORT: 1. Planning Comments The applicant is proposing to change the zoning on the southern portion of the site that was originally identified as the stormwater management area from Hazard Land Zone (P-3) to Arterial Commercial (C-6). The Arterial Commercial Zone (C-6) permits a variety of uses, including an Automobile Service Station, Carwash, Commercial Parking Facility, Convenience Retail, Educational Establishment, Garden Centre and Nursery, Health Office, Hotel, Office, Religious Institution, Repair Service, Restaurant, Veterinary Services and a Warehouse. The proposed zoning is consistent with the rest of Stage 2 commercial lands which are zoned C-6. Had the subject site not been reserved for the stormwater management facility in the Draft Plan of Subdivision it would have been zoned C-6. The proposed zoning complies with the Municipal Plan Arterial Commercial designation. Also, at the same time the new location of the stormwater management facility that the Region now owns should have the zoning amended from Arterial Commercial (C-6) to Open Space (P-2). The zoning amendments are appropriate and compatible with the surrounding area. 3. Department/Agency Comments The application was circulated to all applicable agencies and internal departments and no objections were received. FINANCIAL IMPLICATIONS: No new or additional capital budget requests are associated with this recommendation. COMMUNICATIONS: Circulation to property owners was not required as the application was deemed a Minor Zone Change in accordance with Council Policy 1-1095. 2 CONCLUSION: In summary, the Department of Development and Technical Services recommends that Zone Change Application ZC06/22/I/JB be approved in the form shown in the Proposed By-law. Schedule No. 11 of Appendix "A" to By-law Number 85-1 is hereby amended by designating as Arterial Commercial Zone (C-6) and Open Space Zone (P-2) instead of Hazard Land Zone (P-3) and Arterial Commercial Zone (C-6), on the parcel of land described as Part of Lot 38, GCT, being Parts 1, 2, and 4 on Registered Plan 58R-15010 and Part 3 of Registered Plan 58R-15010 and Parts of 58R-14862 in the City of Kitchener. These lands are shown on Map No. 1 attached hereto. 2. Schedule No. 11 of Appendix "A" to By-law Number 85-1 is hereby further amended by incorporating additional zone boundaries as shown on Map No. 1 attached hereto.
