Gosse, Director of Legislated Services/City Clerk Prepared By: Patricia Harris, Manager of Licensing wards} Involved: Date of Report: November 8, 2006 Report No.: CRPS-06-161 Subject: PUBLIC MEETING -AMEND CHAPTER 533 OF THE MUNICIPAL CODE (DRAIN LAYER) RECOMMENDATION: That a by-law to amend Chapter 533 of the Municipal Code (Drain Layer) be prepared for Council's consideration on November 27, 2006, based on the proposed by-law dated November 6, 2006 attached to Corporate Services Report CRPS-06-161. BACKGROUND: At the Council meeting of September 25, 2006 it was resolved that staff prepare a by-law to amend Chapter 533 of the Municipal Code (Drain Layers) to add a definition fora "Master Drain Layer" and further that staff initiate the required public process with respect to the amending by- law. REPORT: A drain layer is currently defined in Chapter 533.1.2 as a person engaged in the laying of drains on private property between the property line, or in the case of a water main, between the property line or shut off box, and a point not more than 0.609 metres (2 feet) inside the outside wall of a building. The City currently requires that anyone laying drains must obtain a licence. In amending Chapter 533 the definition for a drain layer has been changed to Master Drain Layer which shall mean a person who is skilled in the planning, superintending and laying of drains on private property between the property line or in the case of a water main, between the property line and shut off box and a point not more than 0.609 (2 feet) inside the outside wall of the building. A Master Drain Layer shall have a regular place of business in Ontario and the Master Drain Layer shall lay drains and/or supervise drain layers who lay drains. By amending this definition the City will require only Master Drain Layers to obtain licences and to write an exam if the Chief Building Official deems it is necessary to determine qualification. FINANCIAL IMPLICATIONS: None COMMUNICATIONS: A Public Notice was placed in The Record on November 10, 2006 advising this amending by- law would be considered on November 20, 2006. (MRS) PATRICIA HARRIS MANAGER OF LICENSING DRAFT BY-LAW NUMBER NOVEMBER 6, 2006 OF THE CORPORATION OF THE CITY OF KITCHENER (Being a by-law to amend Chapter 533 of The City of Kitchener Municipal Code with respect to Drain Layer). WHEREAS it is deemed expedient to amend Chapter 533 of The City of Kitchener Municipal Code as adopted by By-law 88-100; NOW THEREFORE the Council of the Corporation of the City of Kitchener enacts as follows: Section 533.1.2 of Chapter 533 of The City of Kitchener Municipal Code is hereby deleted and the following substituted therefor: "533.1.2 "Master Drain Layer" means a person who is skilled in the planning, superintending and laying of drains on private property between the property line, or in the case of a water main, between the property line or shut off box and a point not more than 0.609 metres (2 feet) inside the outside wall of the building. A Master Drain Layer shall have a regular place of business in Ontario and the Master Drain Layer shall lay drains and/or supervise drain layers who lay drains." 2. Sections 533.2.4, 533.2.6, 533.2.7, 533.2.8 and 533.2.10 of Chapter 533 of The City of Kitchener Municipal Code are hereby amended by deleting the words "Drain Layer" and substituting "Master Drain Layer" therefor: PASSED at the Council Chambers in the City of Kitchener this day A.
