HomeMy WebLinkAboutCouncil - 2006-12-11 SSPECIAL COUNCIL MINUTES DECEMBER 11, 2006 CITY OF KITCHENER A special meeting of City Council was held at 1:30 p.m. this date, Chaired by Mayor C. Zehr and the following members present: Councillors G. Lorentz, K. Galloway and C. Weylie. Notice of this special meeting had been previously given to all members of Council by the City Clerk pursuant to Chapter 25 (Council Procedure) of the Municipal Code. Moved by Councillor K. Galloway Seconded by Councillor G. Lorentz "That an in-camera meeting of City Council be held immediately following this special meeting to consider a labour relations matter and a matter subject to solicitor-client privilege." Carried. The meeting then recessed at 1:31 p.m. and re-convened at 5:47 p.m., Chaired by Mayor C. Zehr and with the following members present: Councillors C. Weylie, K. Galloway, J. Gazzola, and G. Lorentz. Council considered a recommendation arising from the Development and Technical Services Committee meeting held this date regarding traffic calming measures on Greenbrook Drive. Moved by Councillor C. Weylie Seconded by Councillor G. Lorentz "That the temporary traffic calming chicanes on Greenbrook Drive be removed; and, That Transportation Planning hold an Open House no later than February 2007 to inform the residents that staff proposes to install a series of 8 speed humps strategically located along Greenbrook Drive, during the 2007 construction season; and, That the intersection narrowing on Greenbrook Drive at Birchcliff Avenue be installed on a permanent basis in 2007; and further, That a resident survey on the effectiveness of the speed humps be conducted 6 months after their installation and a report be prepared for Council outlining the neighbourhood's position." Carried. With the unanimous consent of all members of Council present and in accordance with Section 25.4.4 of Chapter 25 Council Procedure) of the Municipal Code, Council agreed to consider an item not listed on the special Council agenda, as it was deemed to be of an urgent nature. Council considered the recommendation arising from the Development and Technical Services Committee meeting this date regarding temporary occupancy of 165 Victoria Street South. Moved by Councillor C. Weylie Seconded by Councillor G. Lorentz "That enforcement of the City's Zoning By-law be waived with respect to operating an educational establishment (driver's training school) at 165 Victoria Street South, within a building existing on December 11, 2006, and temporary occupancy be approved subject to the use vacating the location in the event the City initiated Zone Change ~ZC06/06ITClRM) to permit educational establishment uses on the subject lands in combination with other permitted uses is not approved; and further, That in the event of failure to vacate, the City's Municipal By-law Enforcement Officer be directed to commence notice of action to remove the illegal use and that any work done to the premises be at the sole risk and responsibility of the owner in the event losses are incurred as a result of final disposition of this application." Carried. SPECIAL COUNCIL MINUTES DECEMBER 11, 2006 - 344 - CITY OF KITCHENER It is noted for the record that the item listed on the special Council agenda regarding JHS Properties Inc., Deer Ridge Drive -Plan of Subdivision 30T-06202, was not dealt with and will be coming forward as part of the Development and Technical Services Committee report on December 18, 2006. Moved by Councillor K. Galloway Seconded by Councillor C. Weylie "That leave be given the Mover and Seconder to introduce a by-law to confirm all actions and proceedings of the Council and that the same be taken as read a first, second and third times, be finally passed and numbered 2006-233 by the Clerk." Carried. This meeting adjourned at 5:50 p.m. MAYOR CLERK
