RECOMMENDATION:
A. That Zone Change Application ZC05/08/KITB, proposing a change in zoning from
"Warehouse District Zone (D-6),138U, 9H" to "Warehouse District Zone (D-6), 138U, be
approved, in the form shown in the attached "Proposed Bylaw", dated June 14, 2005,
without conditions.
BACKGROUND:
This Zone Change Application pertains to the lands municipally known as 410 King Street West,
situated at the corner of King Street West and Victoria Street North in the Warehouse District of
Downtown Kitchener. This property is one of three parcels of land within the block bounded by
King Street West, Victoria Street North, Duke Street West, and Francis Street North.
The purpose of this Zone Change is to remove the current "9H" Holding Zone from 410 King
Street West.
As of the date of the writing of this Staff Report (June 14, 2005) the Record of Site Condition
has not been received by the City of Kitchener or the Region of Waterloo, nor has it been
posted on the MOE EBR Registry. However, we are anticipating its imminent submission, and
the resulting Region of Waterloo clearance letter prior to the DTS Committee Meeting of June
27, 2005. If the clearance letter is not received, this matter will be recommended for deferral.
The lifting of the "9H" would allow the portion of the Kaufman building situated adjacent to
Victoria Street, excepting the ground floor, to be considered for multiple residential use.
REPORT
The Zone Change application was circulated to all applicable agencies, and no concerns was
received from Kitchener Transportation Planning Division, Community Services, or the Grand
River Conservation Authority.
It is anticipated that The Region of Waterloo will indicate in their letter that the Region will
support the removal of "H" Holding Provision as the following conditions will have been
resolved:
1. That prior to the removal of the "H" provision of a Record of Site Condition,
acknowledged by the MOE, be received by the City and forwarded to the Region.
2. That the recommendations of the approved Noise Study be included as conditions of
approval on the upcoming consent applications and implemented through a registered
agreement with either the City or the Region.
3. Once the requirements noted above have been addressed, the Region shall forward
a letter authorizing release of the Holding "H" provisions.
COMMUNICATIONS
This Zone Change was circulated to all Agencies on May 20, 2005. (See Circulation letter in
Appendix "A.) In accordance with the provisions of Section 36 of the Planning Act, no property
circulation is required.
FINANCIAL IMPLICATIONS
There are no expenditures required by the City of Kitchener as a result of this Zone Change
Application.
CONCLUSION
It is the opinion of Staff that the proposed lifting of the "9H" Holding Provision for these lands is
in keeping with the intent of the policies of the Municipal Plan, and the environmental
requirements contained in the Zoning Bylaw.
