That demolition control application DC 05/09/B/CB requesting permission to demolish one single detached dwelling, located at 87 Ellis Avenue, legally described as Tract German Company Sub of Lot 4 Part Lot 24, be aooroved in principle, subject to the following conditions: i) That the owner obtain final Site Plan Approval; and, ii) That the owner obtains a building permit for a proposed development. Upon satisfaction of conditions (i) and (ii), the Chief Building Official may authorize and issue a demolition permit under Section 33(6) of the Planning Act. The demolition permit will be subject to the following condition: BACKGROUND That in the event that construction of a new building is not substantially complete within 2 years of the date that demolition is commenced, the City Clerk may enter on the collector's roll, to be collected in like manner as municipal taxes, a sum of $20,000 for each dwelling unit contained in the residential properties in respect of which the demolition permit is issued and such sum shall, until payment thereof, be a lien or charge upon the land in respect of which the permit to demolish the residential property is issued. The subject building is located at the north-west corner of Ellis Avenue and Raitar Avenue, in the Fairfield community. The subject lands currently contain a single detached dwelling. The applicant received approval of a zone change in March of 2005 to permit multiple dwelling or street townhouses. The applicant has submitted a site plan application to construct a 4-5 unit condominium townhouse development. REPORT Pending a review by the City's Site Plan Review Committee and the Building Division, staff are satisfied that a building permit may be issued for the proposed condominium townhouse project. Under Section 33 (6) of the Planning Act, where a building permit has been issued, Council shall issue a demolition permit. As the existing dwelling is not protected by the Ontario Heritage Act, staff have no objection to the approval of a demolition permit. Similarly, the Planning Act allows a municipality to impose a condition, whereby if the applicant has not substantially completed construction within two years of the issuance of a demolition permit, the municipality may issue a fine in the amount of $20,000 per dwelling. Staff feel it is reasonable to apply the above noted condition. Based on the foregoing, staff recommends approval of Demolition Control Application DC05/09/E/CB. FINANCIAL IMPLICATIONS (IF ANY) Not applicable. COMMUNICATIONS Preliminary circulation of the demolition control application was provided to the City's Heritage Planner only. Property owners within 120 metres of the subject property were circulated notice of the zone change application, which identified the desire to construct a multiple dwelling or street townhouse dwelling.
