June 17, 2005 DTS 05-122 THERESA I HENRYI DEVON STREETS RECONSTRUCTION (2004) ENGINEERING FEE INCREASE REQUEST RECOMMENDATION: That the submitted request for increase in fees for consultant services related to Expression of Interest E03-048, Consultant Services - Theresa Street (Victoria Street to Park Street), Henry Street (Victoria Street to Devon Street), Devon Street (Henry Street to Park Street), to account for City initiated changes of scope, extended construction duration and costs related to the unexpected discovery of contaminated soil be approved and that additional expenditures of $50,248.23 beyond the original fee estimate be approved, and that sufficient funding is available for this increase. BACKGROUND: Expression of Interest E03-048, was awarded to Cumming Cockburn Ltd. (CCl) September 29th, 2003. Subsequent to the awarding of the contract to CCl, several factors have contributed to an expanded scope and extended construction duration which have increased the level of services required of CCl. After the services of CCl were retained and a purchase order issued, the City requested the scope of the project be expanded to complete some additional improvements in the vicinity of Victoria Park including the installation of a sidewalk in a heavily used pedestrian area along Jubilee Drive. Other additions to the contract included replacing a small section of old watermain adjacent to the project limits. The remainder of the changes to the scope of work were the result of unanticipated discoveries on-site which consisted of contaminated soil on a section of the Theresa Street right-of-way, the discovery and removal of sea shells (waste product from an old button factory), and the removal of unsuitable native materials. The following table summarizes the expanded scope and associated engineering costs. It is staff's opinion that CCL's request for compensation is warranted and that the proposed fee increase is reasonable.
