HomeMy WebLinkAboutDTS-05-166 - Limiting Distance Agreement - 715 Fischer-Hallman Rd & Adjacent Hydro Corridor ) ~ Development & Technical Services ~ Report To: Date of Meeting: Submitted By: Prepared By: Ward(s) Involved: Date of Report: Report No.: Subject: Christina Weylie, Development and Technical Services Committee October 1 7, 2005 Michael Seiling, Acting Chief Building Official, Ext. 2669 Robert Schipper, CBCO, Ext. 2846 Ward 4 September 22, 2005 DTS 05-166 LIMITING DISTANCE AGREEMENT WITH OWNER OF 715 FISCHER HALLMAN ROAD AND ADJACENT HYDRO CORRIDOR, PURSUANT TO SECTION 3.2.3.1.(8) OF THE ONTARIO BUILDING CODE RECOMMENDATION: That the Mayor and Clerk be authorized to execute an agreement with the registered owner(s) of Part Lot 47, G.C.T. being Part 4 on Plan 58R-14676, known as 715 Fischer Hallman Road, pursuant to Section 3.2.3.1.(8) of the Ontario Building Code, said agreement to permit the construction of a new office/retail building with the limiting distance for the exposing building face being measured to a point beyond the property line on the adjacent property, Part Lot 47, G.C.T. being Part 3 on Plan 58R-14676, known as Hydro Corridor. BACKGROUND: The Building Code limits the number of unprotected openings (ie: windows and doors) in exterior walls to reduce the potential for fire spreading to adjacent buildings, existing or proposed. However, Section 3.2.3.1.(8) of the Building Code does permit an increased number of unprotected openings if an agreement has been entered into with the municipality and the adjacent property owner to establish the point to which the limiting distance for an exposing building face shall be measured beyond the property line. REPORT: The owner of the subject lot wishes to construct a three storey commercial building with more unprotected openings in the South sidewall facing Hydro Corridor, than the available limiting distance will allow. In this instance 8.0 metres are required but only 1.2 metres are provided. The owner would like to allow 34% unprotected openings on this wall face, but the current limiting distance only allows 8% unprotected openings. An additional limiting distance of 6.8 metres onto the adjacent property would permit the proposed building to be constructed with 34% unprotected openings presently shown on the design drawings. FINANCIAL IMPLICATIONS: N/A COMMUNICATIONS: N/A CONCLUSION: Building staff have reviewed this request and have no concerns with the additional limiting distance of 6.8 metres onto the adjacent property. The adjacent lands being used to achieve the required limiting distance is currently a hydro corridor owned by Hydro One and there are no buildings or structures in this area. Further, we have attached a letter from Hydro One, dated April 5, 2005, giving their consent to allow a maximum of 10 metres to be used to achieve the limiting distance required by 715 Fischer Hallman property. Therefore, it is in order to authorize the Mayor and Clerk to execute an agreement pursuant to Section 3.2.3.1.(8) of the Building Code.
