DTS-07-007 - DEMOLITION CONTROL APPLICATION DC 06I09IQIAP - 242 QUEEN STREET SOUTH - REACHING OUR OUTDOOR FRIENDS tROOF) The Committee considered Development and Technical Services Department report DTS-07- 007, dated January 2, 2007, regarding Demolition Control Application DC 06/09/O/AP for lands known municipally as 242 Queen Street South. On motion by Councillor B. Vrbanovic - it was resolved: "That Demolition Control Application DC 06/09/O/AP requesting permission to demolish a dwelling located at 242 Queen Street South, owned by Reaching Our Outdoor Friends (ROOF), legally described as Part Lot 57, Plan 393, be approved, without conditions." DTS-07-002 - ZONE CHANGE APPLICATION ZC 06I27IQIRM - 5$$-59$ QUEEN STREET SOUTH - DAVOOD KHOSROWSHAHIAN The Committee considered Development and Technical Services Department report DTS-07- 002, dated December 27, 2006, regarding Zone Change Application ZC 06/27/O/RM to change the zoning on the lands known municipally as 588-598 Queen Street South. Mr. Mounsey presented the report noting that the Commercial Residential 2 zone will allow residential units plus a range of commercial uses on the ground floor. He advised that the previous use of this property included a gas bar; for that reason a holding provision will be applied until a Record of Site Condition has been submitted, satisfactory to the Region. The holding provision will also require submission of a transportation noise study satisfactory to the Region, before the site can be developed. He also noted that the property owner is working with the Region respecting the inclusion of some affordable housing units in this proposed building. Mr. Mounsey noted that neighbourhood issues raised through this process included traffic impacts, building height and the clean-up of the property. Mr. Mounsey concluded by stating that the zone change has been supported by staff on the basis of the site plan attached as Appendix B to the staff report; however, the design could change as long as it complies with the zoning. Mayor Zehr questioned the accessory building/workshop shown on the site plan. Mr. Mounsey responded that it may be used for storage as an accessory use to the office proposed for this building, or it may be used for parking, but whatever the use, it will be accessory to the main use(s) on the property. Mayor Zehr then questioned whether all the residential units will be limited to 51 sq. m. in area, and Mr. Mounsey responded that some units will be below that area and some will be above, but collectively the parking requirement for all units will not exceed the number of parking spaces provided on the property. Heal, an area resident, advised she had previously provided a written submission; however, new information had been provided this afternoon, and she wanted to make further comments. She stated that although she is not opposed to the proposed development, and she is pleased the property will be cleaned up, she has concerns with future property management. She questioned whether the owner or the Region will be responsible for the property management, and whether there will be an opportunity for future public input in this regard. Mr. Willmer responded that it is not appropriate in a land use question to deal with property management. The question to be addressed at this meeting is land use. Staff has included the proposed property design in this report, to give the neighbours a better idea of what will be developed on this property. On motion by Mayor C. Zehr - it was resolved: "That Zone Change Application ZC 06/27/Q/RM (588-598 Queen Street South) for the purpose of changing the zoning from Arterial Commercial Six Zone (C-6) with Special Use Regulation 88U to Commercial Residential Two Zone (CR-2) with Special Regulation 450R to permit a minimum sideyard setback of 1.2 metres instead of 3.0 metres and subject to holding provision 53H which requires preparation of a transportation noise study and Record of Site Condition to the satisfaction of the Regional Municipality of Waterloo on lands legally described as Part Lot 71, Subdivision of Lot 17, German Tract, City of Kitchener, be approved, in the form shown in the "Proposed By-law", dated December 27, 2006, attached to Development and Technical Services Department report DTS-07-002, without conditions; and further, That the site plan to be approved for 588-598 Queen Street South be based on the concept plans and drawings generally in accordance with those appended to Development and Technical Services Department report DTS-07-002." DTS-07-009 - DIRECTION FOR PROCESSING - MUNICIPAL PLAN AMENDMENT MP 06I01IG - ZONE CHANGE APPLICATION ZC 06I05IG - SANDBERRY INVESTMENTS -GLASGOW STREET The Committee considered Development and Technical Services Department report DTS-07- 009, dated January 3, 2007, regarding processing an Application fora Municipal Plan Amendment and an Application for a Zone Change for land on Glasgow Street owned by Sandberry Investments. The Committee also considered correspondence from Mr. P. Britton, MHBC Planning, dated January 3, 2007, on this same matter. Mr. Willmer advised the Committee that the real request regarding processing these applications is contained in Mr. Britton's correspondence. He also advised that he agrees with Mr. Britton's request, and that it is past time for these applications to be circulated. Planning staff would have liked to co-ordinate circulation of these applications with similar applications to be circulated by the City of Waterloo, but if such co-ordination is not possible, then staff are prepared to proceed independently. Mr. Willmer presented two short amendments to Mr. Britton's recommendations to clarify that Joseph Urban Consultants presented the lowest bid, and that the property owners will pay the cost of the peer review to the municipality, not the consultant, as the peer review is being undertaken by the City of Kitchener, although it is being paid for by the applicant. Mr. Britton, MHBC Planning was in attendance on behalf of the Voisin family and Mr. P. Dietrich. He advised that the recommendations contained in his correspondence are not intended to prejudge the outcome. He advised that the amendments to the recommendations put forward by Mr. Willmer are acceptable, and clarify his original intention. He stated that the consultant will report to the municipality but be paid for by the applicant. DEVELOPMENT & TECHNICAL SERVICES COMMITTEE MINUTES JANUARY $, 2007 - 3- CITY OF KITCHENER 3. DTS-07-009 - DIRECTION FOR PROCESSING tCONT'D) With respect to recommendation #1 in Mr. Britton's correspondence, Mr. Willmer advised that he is in agreement, and that it does address the concerns expressed by Mr. Britton. Mr. Willmer advised that a process was entered into by the Cities of Kitchener and Waterloo and the Region of Waterloo in terms of processing applications for lands located in the two municipalities. It was originally intended that application processing be co-ordinated between the 3 municipalities; however, if they can't be co-ordinated, Mr. Willmer stated that he is willing to proceed without the City of Waterloo. Mayor Zehr noted that an issue related to this matter will be discussed at Regional Council this week, and Mr. Britton advised that he will be appearing at Regional Council on this matter. Mr. Britton advised that the issue to come before Regional Council deals with criteria that relates to inner-city development and not greenfield development. He stated that the applicants do not want this land to be included in a process that does not apply in this circumstance. Mr. Britton then advised that he was prepared to co-ordinate this development process with the City of Waterloo; however, if they are not prepared to proceed at this time, he is asking the City of Kitchener to take the lead. On motion by Councillor B. Vrbanovic - it was resolved: "That planning staff be directed to process Municipal Plan Amendment Application MP06/01/G/BS and Zone Change Application ZC06/05/G/BS in accordance with standard City procedures and with the objective of expediting a final City Council decision regarding the applications; and further, That planning staff be directed to retain Joseph Urban Consultants, as least cost proposal among qualified consultants, to undertake a peer review of the Market Feasibility and Impact Report prepared by John Winter and Associates Limited with the cost of the peer review to be paid for by the applicants, to the municipality." 4. DTS-07-003 - SOUTH STRASBURG TRUNK SANITARY SEWER INITIATION OF ENVIRONMENTAL ASSESSMENT The Committee considered Development and Technical Services Department report DTS-07- 003, dated December 20, 2006, regarding South Strasburg Trunk Sanitary Sewer Schedule `B' Class Environmental Assessment. On motion by Councillor G. Lorentz - it was resolved: "That the normal procedure for the selection of Engineering Consultants be waived, and the City retain Stantec Consulting Limited as Engineering Consultant to undertake a Schedule `B' Class Environmental Assessment to determine the alignment of the South Strasburg Trunk Sanitary Sewer; and further, That the Mayor and Clerk be authorized to execute an Engineering Agreement for the provision of professional engineering services between the City of Kitchener and Stantec Consulting Limited at a total cost of $251,493.81, for completion of the South Strasburg Trunk Sanitary Sewer Schedule `B' Class Environmental Assessment." 5. NEW FIRE STATION -SOUTH END OF KITCHENER Councillor K. Galloway requested that Mr. Browning provide her with the analysis done to support the location of the new fire station being built in the south end of Kitchener. UNFINISHED BUSINESS AGENDA Mayor Zehr commented on the length of time the issue of sidewalks in industrial areas has been on the unfinished business agenda.
