Subject: PROPOSED DELTA STREET CLOSURE & EA
RECOMMENDATION:
That Delta Street between Sydney Street and Preston Street be closed by by-law; and,
That the 20 foot strip of land adjacent and to the North of Delta Street be declared surplus to the
City's needs; and,
That portions of the lands be sold to adjacent property owners and easements be retained as
required; and,
That a 10 foot strip of Delta Street be retained and developed to become a portion of the Iron
Horse Trail from Sydney Street to Preston Street; and,
That some of the proceeds of the sale be used to do fence improvements and the installation of
a trail within the retained lands; and further,
That the Mayor and Clerk be authorized to execute any necessary documentation to facilitate
these transactions.
BACKGROUND:
Council may be aware that Mr. Seegmiller of Rockway Holdings Inc. approached Mr. F. Pizzuto
in 2004 to request that the City consider the closure of Delta Street to allow his company to
purchase the lands created by this closure. Seegmiller proposed a residential development on
their lands and were proposing to have frontage onto the adjacent Rockway Golf Course.

REPORT:
The Property Management Committee responded to this request. Staff approached the two
other adjacent owners, Potje Holdings Inc. of 48 Preston Street and Merlin Machine Co. of 69
Sydney Street and confirmed that these owners were also interested in purchases of portions of
Delta Street and the City owned 20 foot parcel flanking Delta Street.
Staff responded to a suggestion by Mr. Jutzi and proposed to retain a 10 foot strip of land to
become part of the Iron Horse Trail from Sydney Street to Preston Street. To deal with safety
issues relating to stray golf balls from number 10 fairway of Rockway Golf Course, staff
recognize that fence modifications are required and propose to address these issues in the
design of the trail.
An appraisal of the lands was commissioned, and on January 31, 2005, City Management &
Appraisals Ltd. provided their report.
In 2005, MTE Consultants Inc. was retained to perform a Schedule "B" Class Environmental
Assessment. In the performance of this task, public notices were placed in the K-W Record on
January 13, 2006 and January 20, 2006. Public comments were received and responses were
initiated. See the MTE plan attached for reference.
A reference plan was commissioned to legally identify the parts to be sold and the easements to
be retained. In addition, this plan provided for identification of lands over which easements need
to be purchased by the City for pipes on private lands of all three owners mentioned above.
Subject to approval of this report, staff can proceed to negotiate with the interested parties to
transact the lands at fair market value and to procure easements to provide details to the City's
Legal Division to complete these transactions.

Funds received from these transactions will be put in the Asset Management Reserve.
