Subject: EXEMPTION TO CHAPTER 450 (NOISE) -GRAND RIVER
TRANSIT
RECOMMENDATION:
That an exemption to Chapter 450 (Noise) of the City of Kitchener Municipal Code be granted to
Grand River Transit to undertake renovations to the downtown transit terminal between the
hours of 7 PM and 7 AM on various dates between June 5t" and June 23rd, 2006, excluding any
Saturdays or Sundays.
BACKGROUND:
The Grand River Transit Authority, and its contractor, Greyhound Contracting Inc. is planning to
undertake renovations to the downtown transit terminal that will involve the cutting and removing
of various sections of the concrete floors. At this moment is difficult for the contractor to judge
how much of this work can be done during the hours that the terminal is open. It is possible that
some of the work may need to be done after the terminal closes for the night (ie. 11 PM). Thus,
the GRT is requesting an exemption from Chapter 450 (Noise) as a precautionary measure.
REPORT:
The renovations will involve the cutting and jack-hammering of various sections of the concrete
floor. The jack-hammers require a gas powered compressor to operate and this device must be
situated outside.
The GRT and the contractor have committed to doing their utmost to control the noise issue and
advise that they anticipate that the use of the jack hammers and compressor will likely only
involve 3-4 nights during the 3 week project. However, they cannot predict which of the nights
will be affected.
FINANCIAL IMPLICATIONS:
None identified at this time.

CONCLUSION:
Based on the circumstances surrounding this event, the By-law Enforcement Division does not
object to this request for an exemption.
