Subject: BY-LAW TO DEDICATE AS PUBLIC HIGHWAY
ROAD WIDENING ALONG FRONTAGE OF 165 DUKE
STREET EAST
RECOMMENDATION:
That the lands for road widening along the frontage of 165 Duke Street East, being Part of
Lot 12 "Marked N. Ziegler" and Part Lot 18, North of King and West of Cedar Streets, B.
Eby's Survey, Registered Plan 364, being Parts 12 and 13 on Reference Plan 58R-15060,
in the City of Kitchener and Regional Municipality of Waterloo be dedicated and declared
to be a public highway forming part of Duke Street;
REPORT:
The subject road widening is along the Duke Street frontage of 165 Duke Street East being that
part of the Market Block on which the Barrel Works Market Residences are being built. On June
20, 2005 Council passed By-law No. 2005-118 authorizing the reduction in the required road
widening at this location to two (2) metres to accommodate the development of the abutting
lands for a multiple residential building.
The stratum of lands on which the multiple residential building is being built, and appurtenant
easements, is being conveyed to Barrel Works Market Residences Inc. in accordance with the
purchase agreement with the City. It is therefore necessary to dedicate the road widening as a
public highway so that the public street frontage is provided.
