HomeMy WebLinkAboutCRPS-06-136 - Consent & Waiver of Notice of Appl for 1st Registration in Land Titles System - P Kruse - Hidden Valley Rd Report To: Committee of the Whole Date of Meeting: September 11, 2006 Submitted By: Lesley MacDonald, Director of Legal Services and City Solicitor (Ext. # 2267) Prepared By: Lesley MacDonald, Director of Legal Services and City Solicitor Ward(s) Involved: WARD 3: FAIRWAY -GATEWAY -JOHN GAZZOLA Date of Report: September 7, 2006 Report No.: CRPS - 06 -136 Subject: Consent and Waiver of Notice of Application for First Registration in Land Titles System by Peter Dietrich Kruse for Part 1 on a draft Reference Plan -Hidden Valley Road RECOMMENDATION: That the following recommendation be presented to Council at its meeting scheduled for September 11, 2006, for enactment: "That the Mayor and Clerk be authorized to execute a Consent/UVaiver of Notice (Application under Subsection 46(2) of the Act) to expedite an Application for First Registration in Land Titles by Peter Dietrich Kruse respecting lands described as Part of Lot 3, Registered Compiled Plan 1522, designated as Part 1 on the draft Reference Plan attached to the Application, being land in the vicinity of Hidden Valley Road, Kitchener." EXECUTIVE SUMMARY: N/A BACKGROUND/REPORT: The owner of the subject property has made application to the Ministry for first registration under the Land Titles Act and since the City has an interest in abutting lands, the owner is obligated by law to provide the City with notice of the Application or in the alternative, obtain an executed Consent and Waiver of Notice. In an attempt to expedite this process, the City has been asked to consent to the Application and waive its right to notice. The appropriate staff have reviewed the application and have no objections, therefore I am recommending that the City comply with the Applicant's request. FINANCIAL IMPLICATIONS: COMMUNICATIONS: N/A CONCLUSION: I am providing you with a Copy of the Draft Reference Plan for your review. If Council provides its consent, a Consent and Waiver of Notice should be executed by the Mayor and Clerk.
