Subject: REQUEST RE CONVEYANCE OF PUMPING STATION AT
1990 OTTAWA STREET SOUTH TO REGION OF
WATERLOO PURSUANT TO ASSUMPTION BY-LAW
RECOMMENDATION:
"That Part Lot 46, German Company Tract and Part Lot 130, German Company Tract
being Part 1 on Reference Plan 58R-4780, City of Kitchener, Regional Municipality of
Waterloo be conveyed to the Region of Waterloo pursuant to the Region's Assumption
By-law 13-72; and further,
That the Mayor and Clerk be authorized to execute any necessary documentation
required by the City Solicitor."
BACKGROUND:
On December 28, 1972, the Regional Municipality of Waterloo passed By-law Number 13-72 to
assume as part of the Regional Waterworks System, all works for the production, treatment and
storage of water operated by, or on behalf of, each area Municipality or any local Board thereof,
and all rights and obligations of an area Municipality or local Board in relation to such works.
The said By-law included the pumping station located at 1990 Ottawa Street South and legally
described as Part Lot 46, German Company Tract and Part Lot 130, German Company Tract
being Part 1 on Reference Plan 58R-4780.
Title to the said pumping station has never been transferred to the Region of Waterloo and
therefore remains in the name of The Corporation of the City of Kitchener.
REPORT:
The Region has requested that title to the said pumping station be conveyed to them.
FINANCIAL IMPLICATIONS:
There are no financial implications to the City. The Region of Waterloo will pay the registration
costs to register the Transfer.
COMMUNICATIONS:
Uitilites has confirmed that no City money is spent on the pumping station and that the operation
and maintenance of same is entirely the Region's responsibility.
