EXECUTIVE SUMMARY: N/A BACKGROUND: In accordance with the discussion at Finance and Corporate Services Committee on Monday November 20, staff have been asked to attend in person to make representations on Bill 130 before the Standing Committee on General Government regarding two concerns, one pertaining to the municipality's ability to establish corporations and the other pertaining to the closed meeting provisions and the absence of an exemption pertaining to matters which other than fact not in writing, would otherwise be prohibited from release under the Municipal Freedom of Information and Protection of Privacy Act. In addition, staff has been asked to file a written submission with respect to any other identified concerns with the proposed amendments. REPORT: The attached submission has been prepared setting out other areas of concern or comment for the benefit of the Committee on General Government, to be filed upon receipt of Council's approval. The submission is to be filed with the standing committee by 5:00 p.m. on Wednesday, November 29, 2006. FINANCIAL IMPLICATIONS: Not known at this time. COMMUNICATIONS: N/A CONCLUSION: It is to the Municipality's benefit to file submissions with respect to any areas of concern with Bill 130 with the hope that the Province will give due consideration to the comments and perhaps incorporate some, if not all of the suggested changes in the Bill. The submissions also contain the commitment from the City of Kitchener to participate in discussions with the province on any of the points raised should they so wish, with the hope that such discussions may advance further changes to the legislation. ~esiey Niacuonaia, Director of Legal Services and City Solicitor /tr attachment cc.
